The two young Burmese accused of the murders of Hannah Witheridge and David Miller on the Thai island of Koh Tao were sacrificed in the interests of continued police co-operation between the Royal Thai Police and Scotland Yard.


Ruling that the defence could not be given the whole or parts of the Scotland Yard report on which the families issued damning statements through the Foreign and Commonwealth Office implying the guilt of Zaw Lin and Wai Phyo – a High Court Judge quoted the ‘chilling effect’ argument of a breakdown in co-operation between the law enforcement authorities of Thailand and the United Kingdom.



Counsel for the prosecution Anya Proops had argued that such was the power of the British public interest that it would still trump private interest – even though this caused Justice Green ‘considerable unease’ in a capital punishment case where ‘the stakes could not be higher’.

The ‘chilling effect’ argument posed by the Metropolitan Police Service in the UK was the ‘substantial and adverse effect on law enforcement, fulfilment of public policy and the UKs security objectives’.

But what appears clear from the judgment is that Scotland Yard officers even in their ‘observational role only’ were not present at any interviews, were not witness to any DNA procedures, and were reliant on the documents and videos placed in front of them and what they were told through a Thai police interpreter, or English speaking Thai officers.




Nevertheless the report made specifically for the families then led the families to issue statements through the Foreign and Commonwealth Office saying that the evidence against Zaw Lin and Wai Phyo ‘appeared powerful and convincing ‘and led the Thai authorities to state that ‘relatives of the deceased in the UK have stated that they are confident in the evidence in the Koh Tao case and that the evidence was clear beyond a shadow of doubt’.

Judge Green said he gave weight to the assertion by Gerry Facenna, counsel for Zaw Wyn and Wai Phyo that these statements had prejudiced the trial.

The author of the report Scotland Yard report Detective Chief Inspector Lyons said he had written an impartial report with no value judgments about the Thai police operation.

But he countered claims by the two Burmese that they were forced to confess after torture by stating that they had confessed on a number of occasions including 'in front of a judge and in the presence of their own counsel'.

Ironically one of the objections made by Anya Proops for Scotland Yard was not only the sensitivity of the Thai government to the case and the risk that the report might be used to engender further public criticisms, but also importantly the release of details of the Scotland Yard report could ‘prejudice the trial’.



The judge explained why he was troubled.

“I cannot ignore the fact that this is a death penalty case conducted with the accused arguing with their eyes closed.’.

He posed a theoretical case.

"A foreign prosecutor fails to disclose to a defendant a key piece of evidence of great value to the defendant in a criminal case.  This item is however recorded in an MPS report and amounts to personal data.   
The report explains that there is compelling evidence that the foreign forensic scientists employed by the police abroad have mixed up DNA samples.  It also records that the prosecution are nonetheless seeking to rely in court upon the wrong DNA evidence to inculpate the accused. 
This entry might be pivotal to the defence and might quite literally represent a matter of life or death.  In those circumstances does the Court sacrifice the accused for the wider principle of comity and trust between authorities? Ms Proops for the MPS submitted that such was the power and force of the public interest objectives the MPS advanced that even in such extreme circumstances the public interest would still trump the private interest.

As he made his ruling rejecting the application made on behalf of the two young Burmese he said:
“I feel considerable unease. I sit a long way from the seat of the trial and do not have a true hands-on feeling for the way evidence has been tendered by the prosecution or the main lines of defence.”

The High Court had heard in August that even though the trial was underway counsel representing the two young Burmese had no way of getting access to the records of the trial.

COMMENT

Such are the ways of the international diplomacy – the Foreign and Commonwealth and British law enforcement authorities have of course been acting in British political, policing and security interests. What is expedient counts. It is remotely possible that continuing good relations with Thai police could save lives, though more immediate is the Thai prosecutor calling for the deaths of two Burmese in jail in Koh Samui.

Of course Justice Green in London was oblivious what was going on in the court on Koh Samui and in that would have been impossible, as he virtually admits, to judge what would be detrimental to the defence or  more importantly useful.



In the trial many prosecution claims, and by that I mean also Thai government and police claims appear to have been blown apart.  Of course I cannot say that for sure. Reporters are not allowed to take notes.  The judge summarises and often just gives a precis of evidence, which he finds relevant, into a tape recorder for transcription.

The ‘running man’ in the prosecution’s evidence has been discredited by a British expert forensic witness in a statement could not possibly ne either of the Burmese.

The forensic team of defence witness Porntip Rojanasund, Thailand’s chief forensic officer, found the DNA of two males on the alleged murder weapon, the hoe, while police could find nothing.  

The post mortem conducted by Thai police on Hannah is contradicted by the post mortem done in the UK. 

Police never checked the CCTV of people leaving the island on the morning of the murder because they did not consider it important.  The list goes on and on.  

And Thailand’s Police Commissioner has claimed that his officer and Scotland Yard ‘read the same books’.

It cannot be denied that the Metropolitan Police ‘chilling effect’ case seemed compelling. If the Royal Thai Police were to stop co-operating the Scotland Yard it could, one supposes. at first glance, be disastrous. 

Thailand is now a well-known hub for British criminals wishing to keep out of the away of the legendary ‘long arm of the law’, though that long arm might be exaggerated. Thailand is also a place where terrorist activity takes place.  Britain needs to control its criminals and people who might seek to cause terror in the UK.

But is a breakdown in international police relations a serious scenario?

Probably not. Should that happen and Thailand blank international police co-operation it would be seen as a pariah state. 

Thailand wants to be respectable. It wants to operate on a world stage. 

Would Thailand keep secrets from Scotland Yard? Maybe; but it does that anyway.  Thai Police only reveal what they want to.

Besides Thailand has a short memory - and what happens under this government, well, happens under this government.

The current military government admits there is massive corruption in the Thai police – which is frequently referred to as a ‘mafia’ organization.  The widespread raids last year on Thailand’s Central Intelligence Bureau and Crime Suppression Division and clear out of some 70 per cent of its senior officers involved in just about every racket in the book speaks for itself.

And in terms of the murders of foreigners in Thailand the Thai Police have a track record of attempting to set up non Thais (as in the Kirsty Jones murder and rape case in Chiang Mai) and interference in the course of justice as in the Leo del Pinto murder case in Pai Mae Hong Son and complaints of torture abound.

In the case of Kirsty Jones, some 12 years of co-operation and not offending Thai police got Dyfed-Powys Police nowhere.

The fact is that Scotland Yard may not want to go public in its dealings with Thai police because also quite simply there are skeletons there to be found by very virtue of how the Thai police work.

Detective Chief Inspector Lyons's report made no comments giving an opinion of the Thai police investigation.

Shortcuts are taken  by the RTP which would be viewed dimly back home in the public arena. 

Thai police almost always need encouragement and they are not always satisfied with a slap on the back and a ‘Well done’.

In fact there is nothing under the sun the Thai Police cannot do except perhaps read the same books as Scotland Yard and apply what they have read.

And behind the Foreign Office's  'non interference in the justice system of other countries' lies a pile of Britons often set up for crimes they did not commit abroad - let alone Burmese facing death row.

Noyes with Thai police and military
Thailand’s Police Commissioner Police General Somyot has ordered that his Immigration Police clean up its act. This was prompted by the fact that members of alleged Erawan Shrine bombing gang say they could cross the Thai border by paying a fee of US$600.

Personally of all my favourite illegal Thai border crossing several were into Burma to see heroin warlord, Khun Sa (Chan Shi Fu), where one simply took the path by-passing the border post, preferably in a mule train.

 In fact on occasions our presence was so large – mules carry film stock in cans – sound man’s booms etc. - that my group could be spotted from outer space.

And we could chat to Border Police (actually not part of the Immigration department) in Khun Sa’s camp, complete with bars and brothels.

But my most favourite illegal border crossing was that of my 7-year-old daughter Annie whom I simply told to walk with me across the Cambodian border last year in full view of Thai and Cambodian officials.



She did that merely by pretending to be in the queue and then walking on, waiting for me to join her. (I did it legally. Annie’s Thai passport was out of date). Thankfully everything was put in order by Cambodian’s Interpol chief shortly afterwards – and I even got a British Embassy letter.

Anyway Somyot is concerned that terrorists can get into Thailand by merely paying a fee. He seems less concerned about foreign criminals getting into Thailand which has always been a great source of income to the Immigration Department.

In fact if you have cash and a good record of criminal activity statistically your future must be assured in Thailand much more than if you were say a British pensioner with a young Thai wife (on all levels). In Pattaya it must be a racing certainty.

There is of course a free flow of criminals paying bail to go home as demonstrated by the David Hanks racketeering case. (Hanks, 66, was charged with racketeering in Pattaya but all Russian witnesses and Russian co-defendant simply hopped it), but also strong evidence that the local Immigration Department has been working to the request, and possibly cash, of Drew Walter Noyes.

Noyes has of course been convicted of extortion and is appealing his conviction (His case comes up again on October 22 if he returns) but he gets an immigration police and military escort, and also managed to get a former employee and Pattaya Times reporter (Ivan Schiffer) deported to Brazil.

But more recently Noyes organized the arrest of Thor Halland (account coming soon) on charges of extortion, somewhat of a Noyes specialty, from a very dubious Frenchman with a history in France of trafficking in drugs.

This case was not taken to Pattaya Police but Immigration who have been working hand in mouth with Noyes for years – so hand in mouth that Noyes’ Pattaya Times printed out their Immigration visa forms.

Currently Drew Noyes’, as reported here is advertising his Keha Condominiums not only through Brit Eric Meadows but extensively through LuxEstate, Pattaya, run by a Belgian called Dirk van Opstal.

Opstal has a very colourful immigration and European history and Noyes is reported to have done him a few favours in the past.  More of this later.

Meanwhile Dirk is advertising Noyes’ ‘Athena’ Gentleman’s Club in Jomtien for 1,75000 baht.

But for that you get nothing and then have to pay Bt55,000 a month rent. Noyes needs key money,  and by past actions from as many people as possible.

This was another of Noyes failed business ventures.  He can attend these sort of clubs but certainly not run one.  Buyer beware.

But what amused me most was Dirk van Opstal’s statement.  “Probably the only legal gentleman’s club in Pattaya and surrounding areas”





What? Gentlemens Club are illegal in Thailand. Where on earth can you get your Times ironed and served with a strong cup of Darjeeling?


But of course Gentlemens' Club in the Pattaya form are not legal and these cannot be confused with the Gentlemen’s Clubs of Mayfair, London. In Pattaya they are of course ‘knocking shops’.  But they are breaking the law by allowing sex to take place on the premises.

Noyes has built a separate entrance for the club’s rooms – hence the claim.

Dirk van Opstal is a friend of course of not only Drew Noyes, but also Jan Jansen the weird Dutchman, one time online casino operator, who runs a pseudo news website out of Phuket.

Jansen was also a star with Noyes at the Silom 310D majority Indian-Thai Lions Club on the basis presumably that it is easier to get elavated where people do not know whom you are.

SPLASH: ‘Now I’m definitely going’ – says Brian Goudie

Banged up in Nong Plalai Prison for cheating a 76-year-old American woman out of his life savings fake lawyer Brian Goudie is now reported to be playing the prison lawyer and offering advice to inmates.

It appears none have taken up his offer as many friends of clients he put there in his role as head of 'Alba Laws' have spread the news.

So now, according to a prison visitor, he has unfortunately drawn the space next to the open toilet in his room.

Ian Tracey, who was shopped by Goudie whom he had asked to defend him against trumped up child sex abuse charges, has now been released is positively delirious and is walking around Pattaya with a jaunty gait.

Within no time Goudie was announcing that he was getting bail and then he claimed he would be leaving Thailand with his girlfriend and daughter.  It appears the girlfriend and daughter, on whom he relied to stay in Thailand, know little of this down in Prachuap Khiri Khan.

I am pretty sure the British UKVI  (Border Agency) do not have an application for his family – but in any case he would have to show some substantial income.

And as for getting bail, Goudie it appears is going nowhere. He has other charges to face including revenge porn. What puzzles everybody is why he turned up for judgment.

His defence had been to merely blame everything on his Thai secretary (the one who was the alleged victim of revenge porn.

And his only witness to that was Scot David Hanks, 66, from Girvan, a former brothel owner in Melbourne, who could not organise a proverbial piss-up in a brewery, and had come to Thailand, by all reports to find cheaper sex.

Hanks had also given evidence on behalf of Noyes. One would have thought Goudie might have learned.

Drew Noyes has been emailing me to say that his colleague is out. And he is still telling Wanrapa Boonsu, his common law Thai wife, that he is coming to hold her hand in the dock on October 22 when he assures her that they will both be acquitted on appeal of their conviction and two year jail sentence for extortion.  At the same time of course he has been hurriedly trying to sell up.

There appear to be a whole range of new charges waiting for him on his return and old victims in the United States have been alerted to his presence across the pond.

He could recently be found in the bars of Jefferson City, Tennessee telling people no doubt of his 17 years in service to the King of Thailand and producing all his ‘Royal’ decorations picked up at the flea market in Bangkok.

Drew Noyes – currently on bail appealing a two year sentence for extortion in Thailand – has put up a video essentially announcing he is sponsoring his ex-wife Nittaya Chaisit to fly to the United States to look after his four children by her.

Nittaya announces that they are still good friends despite the divorce and Nittaya needs to look after the kids while he returns to Thailand to continue his business to support his children.

His business of course includes an extensive career of cheating foreigners in Thailand - and of course his conviction was for trying to extort the Jomtien Clinic out of 7 million Thai baht.

So why Nittaya and not Kung or Naam who have been looking after Noyes’ children by Nittaya for the last four years?

Noyes managed to persuade the Pattaya Courts to give him custody of the children – and has kept Nittaya alive with a small monthly stipend.  She blew the divorce settlement, which included a house quite some time ago.

Nittaya has of course been to the United States – but Noyes ensured not long enough for her to get a green card or citizenship – hence her visa application now. In fact Noyes was adamant that she would not be an anchor around his neck.

I’m guessing the video is to impress people at the Homeland Security and American’s Border Force.



About a year ago some wag put the following illustration of Drew Noyes' wives on the net.



Actually Nittaya, who cannot read or write English, or Thai for that matter, was, when I last looked, the proud owner of land and houses in North Carolina. Noyes had put it in her name to avoid paying tax. But he also got her to sign a Power of Attorney over to him – so the winner takes all and the winner is always Drew.

So why does he not ask Kung (Wanrapa Boonsu) who was also sentenced to two years for aiding and abetting his abortion business?  She kicked him out of his bed years ago and will not go without her own three children she has by Noyes.

Or why not Naam who has also been so the US with him (as nanny) at a time he rejected complaints by Nittaya and Kung

Well for a start Nittaya was the only one he actually married and the two others have received convictions for carrying out his business.

Noyes is of course indicating by this video that he will be acquitted on appeal of all charges, something he has boasted privately many times and which his colleague Brian Goudie – now serving three years – also repeats.

So good to him are the Pattaya Courts that Drew Noyes has also been given custody of another child which he fathered while the woman worked at his ‘Pappa’ and One Stop Service Center’ offices below Keha Condominium in Jomtien, Pattaya.

This child is being looked after by Wanrapa.

It’s a mess of course.

The mother of that child Anchalee is demanding her daughter back claimg not surprisingly Kung and Drew are crooks – and, as they never married, lawyers are perplexed by the court decision.

Needless to say Anchalee now married to a former British army officer and living in Pattaya is fighting back.  Unfortunately the army officer was not in the Royal Marines or 2 Para.

Ordinarily Noyes I'm guessing would have used Brian Wright the godfather of one of his childen by Nittaya to prepare the visa documents.

They used to go trawling for young women together in Jomtien.

However Brian Wright, whose company 'My Thai fiancee' - US Immigration and Law, has since been sentenced to a term of imprisonment for child sexual abuse.

Nittaya should make sure Noyes stumps up first by producing some of his ill-gotten gains.  Otherwise in Tennessee she will be living the life of a Mexican maid.

COUGH UP OR GO DOWN FOR ANOTHER SEVEN - GT200 MAN TOLD

The Brit who sold the Thai army fake bomb detectors known as GT200 has been ordered by  judge to find over £I ¼ million or face another 7 years in jail on top of the one he is already serving.

The court believe he has had banked a lot of the proceeds abroad as of course will have one or two people in the Thai military.

Gary Bolton, 49, from Chatham in Kent, is believed to have made £6.8 million.

Now if they could apply those laws to Bangkok boiler rooms in forthcoming prosecutions (if there are any) that would be a result.

Bolton has three months to miraculously find his cash, the Guardian reports

This is the closest thing yet Britain has come to the Thai practice of paying for releases!

BUT THERE'S BETRAYAL IN HIS HOMELAND

If you’ve got it flaunt it and that certainly seems to be true in the case of Norwegian ‘property developer’ Kurt Svendheim whose house, or rather interconnected houses, were raided in Pattaya ten days ago.

City officials and Thai Customs claimed they were raiding the houses after complaints of noisy parties, but I’m not falling for that one.

Inside they found scores of foreigner males partying with Thai women, and seemed to be impressed with the wealth of the owner, who for some odd reason did not seem to get a mention in the local press in which he advertises frequently.

They also found a massive stocks of wine and champagne and every drink under the sun, plus a Porsche, Ferrari and Rolls Royce.

Svendheim, 47, from Haugesund, another pillar of Pattaya’s high society is the boss of New Nordic Property in Pattaya with several projects on the way so to speak. I am somewhat surprised that he is not a local Rotary Club President.


He is much better known in Norway where together with a colleague Geir Underbakke he sold properties in Brazil and Bulgaria to Norwegians and almost took down the Hjemeland Sparekassen (Homeland Bank).

A lot of these properties did not materialise but not only had he taken millions from investors but also some 70 million Norwegian kroner from the bank – about US$8.3 million.

A bank employee Stale Hasle  faced the music for that and the Norwegian authorities expressed an interest in getting Svendheim him home to testify as they were unsatisfied with his answers over the phone, but that all seems to have died – or has it?

Stale Halsne was sentenced in Stavanger District Court for misappropriating bank funds.  A book was published and the blurb for it says:


The book Betrayal in Hjelmeland is a harrowing account of how a bank's management did everything possible to get press, police and public to believe that they knew nothing about what Ståle Halsne did when he collaborated with Geir Underbakke and Kurt Svendheim and that he intentionally ruined the bank.


Svendheim claimed that the reason his projects went belly up was ‘the recession’ and I have lost count of how many timest hat one has been used.

Thailand is currently undergoing difficult financial times but there was no indication of that at Svendheims's home.

While the Pattaya rags have kept shtum Svendheim did speak to a Thai-Norwegian website to re-assure investors in his properties in Thailand. He is not losing any sleep apparently.

Two of his companies ‘Dream Apartments’ and ‘Holiday Dreams’ have been made bankrupt (Mind you he appears to have 14 assorted companies in this mish mash).






But he says: ‘Thailand Dreams’ and ‘Thailand Dreams III are ‘standing on safe ground’.  I guess there is a Thailand II in there somewhere.

That of course has not stopped rumours that he is hopping off to the Philippines where his Chief Operating Office of the New Nordic Group, a real party animal called Remie Sordam, happens to be the de factor boss of the Angeles (yes it had to be another sex resort) Beach Club.



These guys I have say to these guys make planned joint ventures by Niels Colov and Drew Noyes in Pattaya and Angeles City look like child's play.

And investors who lost all in his projects may be a little irritated by his show of wealth.

Meanwhile, according to press reports, the person who took the fall was a woman called  Pornchanok Kamphapan. According to Khao Sod:

"She told security officers in the raid that her husband, a foreigner who works at a hotel in Pattaya, actually owns the place and likes to invite his friends to parties at the mansion."

Her husband she said was not present which seems a bit silly as he was throwing the party.

However Customs officers took her into custody (very temporarily I am sure)  and estimated that they were owed 1.2 million baht in unpaid taxes - and took the Aston Martin and a good range of booze.

There of course seems to be some mistake here. If what was on show was not taxed then there is something wrong with the tax department's figures.

Expect a Thai solution to this one and of course his current projects will be doing fine....until they are not.

COMMENT:  I care not whether Svendheim is a criminal or not under the eyes of the law - whether the authorities are able to put charges against him or not.  In my book he is. The fact is that someone has gone down for a deal in which he was the prime mover and here in Thailand he is behaving like a glutton without a care in the world, and that there are real victims out there, says it all. 

The recent raid on his premises as usual does not carry with it the hallmarks of professionalism. It just smacks of more gluttony. 

No wonder Alan Morison on Phuketwan, who with Chutima Sidasathian, took on the Royal Thai Navy, is now concentrating on crooked property developers and sounding off about 'outrageous criminality' in the property business.

The problem in Thailand is that if foreigners are defrauded the police will not act - not without a large bung or a message from on high.

Who can forget operations for instance like Harlequin Property which took some £600million out of people's pension funds in the UK to invest in properties in the Caribbean and the head of Harlequin (Thailand) Richard Haughton who set up T.P.M.E to carry on in the same way.

The problem in Thailand is that the local media is part and parcel of the problem.  They want the cash from the advertising these alleged property. They do not care a monkey's uncle whether the projects advertised will ever be built.

The problem is that in Thailand the banks are never the victims - Often they are in on the scam.

The problem is that nobody seems to get it - because it is 'pon proyote' - for the benefit of all except some sucker near the Arctic with dreams of a holiday home in the tropic.

As a Scot I have an affinity with Norwegians. Not with this guy.

 PACK ATTACK CAUGHT ON VIDEO
A long standing Thai practice of ‘pack attacks’ against foreigners in the country’s night life industry has been highlighted again today in a video of a vicious attack by night club guards in Phuket.

The club is not named in the video but is in Patong Beach – but it could be anywhere in Thailand.

These attacks usually happen when foreigners are rude to club staff, have insulted a Thai woman, or have refused to pay a bar bill.

They can be relentless and usually Thais totally unconnected with the incidents join in for the ‘craic’.

They are known to continue long after the victim has become unconscious, even happened to a very well brought up young relative of mine on his third day of his first trip to Thailand.

The website Phuketwan says the attack, a video of which, linked below, was put on Facebook, is up for discussion at police level.

Thailand is of course a great country to have a holiday in – just don’t let your guard down – and if you are going to have that one extra drink too much – then best to do it alone with friends – and do not be surprised if the person welcoming you one minute is your assailant the next.

If you are thrown out of a bar or club in Thailand it will not be by two burly men who will carry you to the door and tell you to get on your way – You can be the centre of an amazing spectacle outside.

There is a trend in the UK of Brits behaving badly reality TV programmes – such as ‘Night Cops’ which seems solely based around bar closing times in the UK . If you behave badly in Thailand the repercussions can be a lot worse.  Just keep smiling.

FAKE SCOTS LAWYER REFUSED BAIL AGAIN AND TOLD MORE CASES PENDING

A fake Scottish lawyer, who created an internet website to discredit a British journalist who exposed his fraudulent activities has been refused bail for the second time to appeal a 3 year jail sentence for defrauding a 78-year-old an American woman.


Brian Goudie, born Brian Gerard James Goldie, in Falkirk, Scotland, was led back in chains to Nong Plalai jail on Thailand, yesterday (Monday) but not before, another man also featured on his site and accused of being a paedophile, announced that he would be suing Goudie  over his CasewatchAsia Google site.

The confrontation took place in Pattaya Court.

Both Goudie and American Drew Walter Noyes,  60, had used the site to discredit Andrew Drummond, author of this website,  accusing Drummond being a fraud, cheat,  blackmailing ‘respectable businessmen’ and even of being a Nazi, after Drummond exposed many of their fraud scams in Thailand.

#DrewNoyes (right) former publisher of the  Pattaya Times has already been sentenced to two years jail for extortion along with his common law wife Wanrapa Boonsu and is currently appealing.

His appeal will be heard on October 22nd – if he returns from the United States.

In order to give his Casewatch site some credibility #BrianGoudie also copied and re-wrote several high profile criminal cases currently in the news in Thailand. One was a report copied from another internet source of the arrest of the man in question for child sexual abuse.

In fact the man had been falsely arrested and is takin legal action both in Thailand and the United States for the tremendous damage to his name and employment prospects - and most newspapers if not all have now removed the story.

But at Pattaya Court when Goudie was asked by the vindicated man to take down his story, Goudie refused,” the falsely accused man reported.

“He said they were Andrew Drummond’s and not his and he had nothing to do with it.  He then said he would keep them up and I would have to sue him to take them down so that is exactly what I will do. 

“Funny how he could say that if they were not his blogs!  Drew Noyes also said in a reply email he had nothing to do with these blogs!”

Although Goudie’s current sentence of three years seems small for the offence he committed of stealing an old woman’s life savings of nearly US$300,000, it seems Goudie may be in for the long term. He also faces revenge porn charges, bankruptcy.

He had previously been jailed for six years in Australia for theft and after leaving Scotland in the 90s a warrant (since expired) was issued for his arrest in connection with a fraud on the Royal Bank of Scotland).

Meanwhile callers to the Key Bar in Pattaya are told by his girlfriend Oui Jirapun: 'Brian not here. He is Koh Samui.'

Its not that she does not know. She was with him in the cells below court on Monday.

The Thai court interpreter brought in to translate at the extortion trial in Pattaya of Drew Walter Noyes has ‘posted’ to Noyes’ Facebook page to say the judgment is wrong and that he was set up for the crime of trying to milk 7 million baht out of a beauty clinic.

Shayachon 'Rose' Yangpreeda, a registered interpreter at Pattaya Provincial Court,  also believed to be an employee at Noyes’ One-Stop-Service-Center, committed the astonishing breach  of impartiality in a post which appears on the Facebook page of Noyes, who falsely claims to be in Newport Beach, CA, and claims he worked for Thailand’s Ministry of Commerce.

She talks about psychopaths and cowards who are out to get Drew Noyes and says he is ‘on top of the world’ for what he has achieved in Pattaya.

And she adds: “I can be a witness to say to the world that – in my personal opinion –someone set you up to be accused for a criminal offence for sure.”

Her comments fly in the face of a judgment at Pattaya Criminal Court against Noyes who was sentenced to two years jail together with his common-law wife Wanrapa Boonsu.

But the wording of her contribution suggests that Drew Noyes has had a hand in the writing of it.

Noyes claims he has been attacked because he is so successful.  He is often referred to by critics as a sociopath and accuses his enemies of all the very things he has been accused of himself.


While Rose’s English is what Thais would consider ‘fluent’ it would not pass muster in a British court.

Drew Noyes has repeatedly stated on the net that he is coming back to face the result of his appeal against conviction and sentence.

And the letter was posted just three days before he is due to surrender to bail, which was given to him to enable him to take three of his nine children in Thailand to the United States.



Drew Noyes’ colleague Brian Goudie, 48, from Falkirk, Scotland, has been jailed for three years for cheating a 78-year-old woman out of 7.8 million Thai baht, and many feel both Goudie and Noyes were lucky to have received such light sentences.

If Noyes wins his appeal against the extortion in which he made demands and threats on Michael Goulet, joint partner of the clinic, on pain of bad publicity in his now defunct Pattaya Times newspaper he faces several new libel cases being brought by Alastair Cooper.

Noyes was first exposed as a fraud by Scott Gold in the Wilmington Morning Star, in North Carolina, before ge arrived in Thailand claiming to have been invited by Royal Proclamation.

The newspaper quoted victims and lawyers for victims, accusing him of share fraud, property fraud and a case sexual harassment, in which he has alleged to have demanded oral sex from a junior employee, to give her more work.

He is currently claiming on Facebook that he being defamed by someone called Seb Mitchell whom he claims to be Cooper. Cooper emphatically denies Noyes’ claims.



COMMENT:  No surprises here. But it does look very much like Noyes had a hand in the writing.  This was the same interpreter my legal team had many rows with in a case being brought against me by Noyes and Hanks. 

A poster had called Hanks a pimp on my site. It was true and not defamatory.  He was the not only the owner but also the licensee of a brothel called Masquerades in Keysborough, just outside Melbourne.  The court found that he was not a pimp and they relied on this woman’s interpretation.  It was the only case I lost – and I put it down to something being wrong in the court.

Under the Thai legal system where no verbatim record is kept of court proceedings the power of interpreter is immense - and we can see from photos who this woman has been associating with. Their claims that they have power in the courts are exaggerated - but this shows there is at least something behind them.

Pattaya can be an area where one feels dirty by association. This is one of those times.

Scottish fraudster Brian Goudie was released from Nong Plalai jail in Thailand over the weekend after a plea by his lawyer that he needed to look after his baby daughter….. and for a stash of cash.

After being released on bail, having spent two weeks of a three year jail sentence for defrauding an American woman out of some 7.8 million Thai baht he said: “It was easy. It was just money.” 

He added perhaps gleefully that his name was not on any of the money.

Goudie., 59, from Falkirk,  who is appealing his jail sentence did not disclose how much he paid to get released. But in prison he boasted that as soon as he did he would leave the country.

He had been working recently with Alan McDonald, the Scottish property fraudster from Hua Hin, who now has a girlfriend in Thailand’s Immigration Office across the Gulf of Thailand from Pattaya.

McDonald is the subject of numerous court cases brought by cheated house-buyers and is being actively sought.

Goudie made his threats on the Facebook site of Oui Jirapun his latest Thai girlfriend, aged 19.

The recipient was a poster called Seb Mitchell, who from reading the posts Goudie believes is Mr. Cooper.

Next month he faces a series of charges including the Thai equivalent of ‘revenge porn’ being brought by an ex-girlfriend and former assistant Boonrod Baikratok - and will have to pay bail again if he stays.

 He is also charged with defrauding two Brits and a German in a property deal.

Noyes too arrived in Thailand and claimed to be a lawyer. Then he started up first PAPPA and latterly One-Stop-Service-Center in Pattaya.

He was jailed for attempting to extort 7 million baht out of the Thonglor Clinic in Jomtien - and police pounced when he accepted the first cash.

He had threatened the Thonglor Clinic with a raid by a rogue police 'consumer affairs' unit and bad publicity in his newspaper.








COMMENT: There go the Thai courts again - after years and years of defrauding foreigners in Thailand the collective Thai justice system still does not get it. This is actually getting quite funny and exciting. Thai justice just prefers the money. Do I think Goudie will hop it?  Probably not. He has nowhere to go. He has made promises to people (which he will not keep ) but he sees himself as a legal expert. Its the game he has played already for ten years in Australia - until he finally lost - and Thailand has been a doddle, if not a costly one, for him. Seems he has spent most of his ill gotten gains and now is relying on others with a lot to lose. Of course his last spell in Nong Plalai will have opened his eyes to a few things he won't want to see again.  The threats of course are meaningless unless the person threatened makes a complaint - and Seb identifies himself - which if I were in his position would not bother to do if I had to rely on Pattaya police for protection. All in all clowns and rooks in control of a justice and penal system in which so many people die.

BOILER ROOMS CURRENTLY TOUTING FOR ‘INVESTORS’ IN ALZHEIMERS CURE

Asia’s infamous boiler rooms have begun offering ‘not to be missed’ shares in a pharmaceuticals firm developing a new drug to combat Alzheimer’s disease.

If anybody wants to buy shares in Acadia Pharmaceuticals do not buy through a telephone cold caller- and especially one reading a script like the one below apparently calling from a room in the Koppel Building in Jakarta.

For starters this guy is claiming a merger is imminent with Pfizer which will send the stock through the roof. Of course if that were to be true it would be insider trading and what fool would tell any old punter that.

In this instance Arcadia is being offered by Coles Asset Management which on its website boasts offices in China and Tokyo.  Coles Asset Management also shows on an internet fraud site – so it may be changing its name shortly. It has a similar name to a genuine company.



The script was written to be tailored by several boiler rooms – and this is one of the ways the business is going. Several, who have made their millions over the last decade or so, like one or two operators in Bangkok known to readers here, are now selling their knowledge, complete with scripts - and now let others handle most of the calls. In this case there has been a leak at the seller's end.

Scams and Frauds Involving High Return Investments
Scam artists will do anything to gain your trust in order to entice you to invest in their schemes. They may make promises of huge profits from investing in offshore markets and may even guarantee the returns to give you a sense of security. They are aware of the large amounts of money you pay in taxes and your frustration with earning low returns. They will pretend to share your opinions and sympathize with your frustration.
In one example, farmers were approached through investment seminars about offshore opportunities with guaranteed returns of 15%. One potential investor was told that the large banks use depositors’ money to invest in these same offshore markets for their own profits.
When someone offers you returns that are more than the going rate, there is more of a risk that you will lose your money. Are you taking on more risk than you can afford?
There are several red flags you can watch out for when evaluating investment opportunities, so make sure you know the risks.
Offshore investment opportunities – once you send your money out of the country, you lose any protections provided by the federal laws. Frauds and scams frequently involve an offshore institution to make it more difficult to trace the transactions. Once your money is in someone else’s control you may have difficulty getting it back.

If you get an unsolicited telephone call about an investment opportunity, be alert to the signs of fraud. You might be a target of a boiler room operation.
Boiler room operations wear many disguises and they are once again rearing their ugly head in. Boiler room operators hope to give you a false sense of security with promises of quick profits – but the only ones that profit are the scam artists, at your expense.
They may be located in the financial district near reputable firms, but their address may be nothing more than a rented space tucked away from the public eye. Rarely, if ever, are the offers they peddle to your benefit. Why would a complete stranger call to offer you a no-risk, high-return investment? It is too good to be true.
To gain your trust, the salesperson may boast of a business idea that sounds probable - perhaps a company in the medical industry with a new technological breakthrough for detecting cancer. The pitch is that with your investment, the company could go public on the stock exchange and make you more money. The scam artist may also try to play on your sympathies - he or she may know that cancer has taken the life of someone dear to you. Or perhaps they know that you are a busy professional, with extra income to invest and little time to do your own research. Regardless of the background, the investment opportunity will be sold on the promise of quick profits.
If the offer is really such a great deal, there should be no need for a broker to cold call strangers to promote it. Ask yourself why they are calling you.
To avoid becoming a victim of a boiler room, watch out for:
Unsolicited phone calls. Don’t be afraid to tell a salesperson not to call again, or simply hang up.
High pressure sales tactics and repeat callers. Take the time to research any investment opportunity and get a second opinion.
Promises of high returns with no risk. Any investment that offers returns higher than the bank rate has risk. If you invest in a high-risk investment, you must be financially prepared to lose your money.
Setups. With the first call, the scam artist may only try to gain your trust by offering information about the company and their alleged success. This is a setup for future calls, when you will be pressured to buy.
Unregistered sales persons. Check the registration of the person offering you the investment.

DREW NOYES FAILS TO SURRENDER ON EXTORTION CHARGE

Drew Noyes, the fake American lawyer convicted of extortion while running a newspaper in the Thai resort of Pattaya today failed to surrender to bail which was granted to him to take his children to the United States.

#DrewNoyes, who is appealing a two year jail sentence for attempting to extort Michael Goulet of the Thonglor Clinic, Jomtien out of 7 million Thai baht – on pain of a police raid and bad publicity in his Pattaya Times newspaper – is due to hear the result of his appeal next Friday.

Another hearing will be heard at Pattaya Court tomorrow which his lawyer had been ordered to attend.

Noyes’ lawyer is expected to claim that he has had difficulty settling his children in the United States. He is reported to have successfully moved three of his four children by his first marriage to Nittaya Chaisit.

The fourth, a daughter is reported to have runaway to Bangkok– and today he tweeted that two other children by his common-law wife Wanrapa Boonsu (also convicted and sentenced to two years in jail for extortion) were ‘now international’.

But that still leaves four children behind in Thailand. One by Nittaya, one by Wanrapa, one by Anchalee, a former worker as his One Stop Service Centre - and one allegedly by Nittaya's niece.

It’s speculated that Noyes will not appear next week when, if not issued tomorrow, a warrant of arrest will be signed.  The court will delay the hearing of the verdict for a month.

If the Appeal court confirms his guilt he is not expected to return.

Noyes was exposed in the United States for alleged property and share fraud and sexual harassment by the Wilmington Morning Star.  He arrived in Thailand pretending to be a lawyer and financial expert and by royal proclamation had come to help the Bank of Thailand and the country out of a financial crisis.

He had told Pattaya Court he had never been to jail and was never going to jail.

FIRST MAFIA THREATS NOW LEGAL ONES - BUT BRIAN GOUDIE'S QUANDARY IS NOW

Brian Goudie, the fake Scottish lawyer, who has become a sort of self-confessed ‘Dr. Evil’ has announced on his pseudo legal website CasewatchAsia that his company Alba Laws and his former assistant Sukanya Worakham are suing the lawyer, who put him in jail.

In a rather weak attempt to cover up that he was found guilty, while the company and his assistant Sukanya were found not guilty – because of course she knew little of his nefarious activities, he claims lawyers are no suing for making false charges.

He adds that the case had been taken against Alba Laws and Sukanya by the mother of a paedophile who committed suicide, he claims, after being sentenced to 38 years for child sexual abuse.

In fact they were all, especially Goudie, being prosecuted by a 78-year-old woman Barbara Fanelli Miller on behalf of herself because Goudie had cheated her out of some US$300,000 -  even pocketing the cash Mrs. Miller had put in for her son’s bail.  

And her son did not commit suicide.  He died of a heart condition for which the mother had tried to get him treated ,which was why bail was so important, There is no treatment in Nong Plalai prison.

Although Miller is recorded as having died in hospital,that is how prison authorities cover up monthly deaths in Thailand’s inhumane and brutal penal system which Embassies say so little about.


Further there remains serious doubt about his guilt and his case is one of several high profile cases which have been brought into question including a major miscarriage of justice featured in the Bangkok Post last weekend.

Goudie then wrote: 
“Worakham was found not guilty on 22nd September after a two year campaign of #internetharrassment spearheaded by a convicted criminal and wanted fugitive had already as good as convicted her on the internet. 
"Worakham had featured on the web site of Andrew Drummond, who is now on the run with seven outstanding arrest warrants.

Goudie of course knows about internet harassment which is of course the purpose of CasewatchAsia.

But there is very little evidence of any campaign of harassment as I have only mentioned her twice – the first time when she had to go to jail because he never gave her the bail money, and the second time recently  when she told the Bankruptcy Court that she had no money and knew little about Alba Laws even though technically she was the boss.  She has been so insignificant that I have not even published a photo of her.

Goudie added:

“A third defendant, Brian Goudie has already lodged documents with Pattaya Court and officers of the Anti-Corruption squad following irregularities being revealed in Court files. Goudie and Worakham were jointly charged and lawyers say it is impossible to convict one party and dismiss against the others.”

Well I do not know what the anti-corruption squad is. But they certainly won't be champing at the bit on this case.

Sounds a bit like his claims that ‘the Australian authorities want to track Drummond down and bring criminal charges’ - after I exposed and published his criminal record in Australia or that Drummond is a ‘convicted criminal and wanted fugitive”.

Goudie does not understand of course that he is being played at his own game.  

As none of the charges brought by him, (not any authority,)would merit even a civil case in the UK – such as publishing this photo-shopped picture of Goudie as a barrister – I was given the opportunity to sit this one out while getting my children into a good school in the UK. 

All I need to do is sit,wait,  and perhaps down a few beers as either Goudie goes to jail or does a runner…and the same goes for Drew Noyes, against whom the clock is rather ticking fast.

I do have to admit though, as a journalist covering crime for some 25 years here,  it remains difficult to find a low life of a sleazier nature than Goudie who has spent his life preying on people who cannot defend themselves. I can’t find a redeeming quality like an element of charm.  Neither can his victims.

I suspect a television programme made about him 'Swindler Scot, Brian Goldie' would have sold better world-wide had he actually been successful.

COMPLAINTS TO GO TO ANTI-CORRUPTION COMMISSION OVER HANDLING OF CLUB RAGE CASE IN SAMUI


Police and prosecutors on the Thai island of Koh Samui are to be asked to account for their behaviour before the Public Anti-Corruption Commission over allegations of perverting the course of justice in favour of the son of a Chinese-American millionaire.

And the Office of the Thai Attorney General will also be called to account in a case in which two former pupils of the Shanghai American School named as 20-year-olds Raymon Chang and Ryan Wang are alleged to have severely beaten Australian Jack Hansen-Bartel, former pupil of the New International School of Thailand, causing him serious injuries in a club on the island in June 2014.

At the centre of the row is American-Chinese millionaire Raymond Nobu Chang, father of one of the accused, who jetted into Samui to defend his son, who was initially with Wang facing charges of attempted murder and causing grievous bodily harm.

In the latest of a series of incidents in the case it now appears that the Samui judges have approved without the knowledge of  Jack Hansen-Birtel and his mother, Annie Hansen ( who is his Power of Attorney) that neither  Raymond Chang nor Ryan Wang will even now have to turn up for their trial on Koh Samui which is scheduled to run from December 1st to 4th.

Hansen-Birtel’s  former lawyers  Prachaya Law, Bangkok, which is on several Embassies’ lists – and was in this case recommended by the Australian Embassy – had not informed their clients of this agreement.

While Raymond Chang is being allowed to continue his studies at Cornell University, New York, Jack Hansen-Bartel, who is on an estimated  4 million baht course of surgery and corrective surgery on his face, will have to fly from Melbourne, Australia to Koh Samui to face a charge of (rough translation) ‘quarreling noisily with other person in a public and uses violence not amounting to bodily or mental harm against any person.’

Jack and his mother only discovered the two American Chinese did not have to face trial after changing lawyer, suspecting Prachanya Vijitpokin the boss of the law firm seemed to be acting for the opposition.

"That is when their new lawyer Lada Sophaphinant read the agreement which was signed on behalf of Jack Hansen-Birtel by Nutchapat Maneewongs of Prachaya Law.

Lada was surprised. A straightforward case had been completely turned around. Even if Jack Hansen-Birtel was guilty of any offence is it the sort of offence which is sorted out on the spot at a police station or at worst at one of the highly publicised tourist courts which were developed specifically for this sort of incident.



The two American-Chinese have been given leave not to attend the trial Section 172 of Thai criminal procedure. Leave such as this is rarely granted.

The law states:

If the court deems appropriate, he may without delay proceed the trial and the taking of evidence in the absence of the accused person in the following cases: 
“In the case that the offence carries a maximum imprisonment for a term not exceeding ten years, whether it is liable to a fine, or that offence is punishable by a fine only, when the accused person has already appointed his counsel and the permission of the court which allows the accused person not to appear before the court during the trial and the taking of evidence has been granted.”

Had they been asked neither Jack nor his mother would have signed such an agreement.  The circumstances of the case, they say, are black and white.  He was viciously attacked without provocation at the Green Mango Club,  Chawaeng Beach, Koh Samui.

Witnesses identified his assailants and they admitted the offence when they were first arrested – claiming they were going to the aid of a damsel in distress – a holiday girlfriend of Ryan Wang named Tiffany Marika Turner, a half Japanese half  New Zealand student who has just left the Sacred Heart International School in Tokyo.

The case could have been settled quickly – but Jack’s injuries were so serious that multiple operations have been needed to correct facial damage.

 Although even school friends of the American Chinese admitted Wang and Chang were at fault, friends of Jack were quick to act when they heard that he had been accused of harassing. They acquired the entire club’s CCTV on the night and morning of the incident.

Contrary to claims by Turner, Wang and Chang that Hansen-Birtel was hassling Ms. Turner,  the CCTV, shown on ABC’s 7.30 programme, shows Jack and Tiffany walking into the club hand in hand, after Jack says they had exchanged kisses at a pub nearby where they met.  At this point they are confronted by Wang and Chang – and Jack leaves after a short conversation.

After Chang had told him move on as Tiffany was Ryan’s girl Jack was happily to move off and the CCTV confirms his statement.  The attack happened on the dance floor quite some time later. Jack was dancing with friends – who saw no harassment at all.

Enter Raymond Nobu Chang, who describes himself as an‘angel investor’ . He puts on his CV that he was:

“selected by Fortune as one of the twenty-five Next Generation Global Leaders Under 40, (5/2001), and by Business Week Asia as one of Asia’s 20 most influential new economy leaders in the 21st century.”

He was also:

“founder of  GigaMedia, the first broadband internet company in Asia. In 1999, GigaMedia received US$35mm strategic investment from Microsoft, and in 2000, the Company went public on NASDAQ and raised US$280mm, one of the largest IPOs for Internet company prior to 2000.”
Raymond Nobu Chang flew into Samui guns blazing not long after the incident knocking a Channel 7 (Aus.) camera before what appear to be a series of meetings in the office of prosecutor Paiboon Achawananthakhu– the same man prosecuting the two young Burmese for the murders of Hannah Witheridge and David Miller on Koh Tao.

The first turn around was the news from a Police Lt. Danchai, who was involved with the apparently duff Rohingya interpreter in the Koh Tao case, who previously had declared it an open and shut case, announced that Jack was going to be prosecuted.

Things moved from the sublime to the ridiculous when a police officer was dispatched by plane from Koh Samui to Bangkok to interview Jack about his alleged non-violent offence.

Thai Police would as a rule not move an inch on such an enquiry unless their expenses were paid and Jack had allegedly committed an offence for which the penalty would normally be a 500 baht fine. Yet police were prepared to spend hundreds of dollars.

Even the military National Council for Peace and Order were suspicious and they sent as team to oversee the interview to ensure there was ‘transparency’.

There has been little transparency since. That was the NCPO’s only involvement . Despite pleas for help from Mrs. Annie Hansen they took no further action lending support to the belief that Thailand’s crackdown on corruption is somewhat colour coded.  Samui is of course a yellow-shirt stronghold – and the yellow shirts welcomed military invention into Thailand’s affairs.

Meanwhile Thailand’s Ombudsman intervened.  He sent a representative to Koh Samui and after his visit prosecutor Paiboon was ordered to step down from the case.

But it was then put into the hands of his deputy  Teerawut Prammahan, who sits opposite him in his office.  Many requests by Hansen-Bartels lawyers for copies of the statements of Chang, Wang and Turner, have not even been acknowledged – even though under the same Criminal Procedure section refusal is a criminal offence which carries with it a fine and prison sentence.

The court has been given a witness list, but still not one of the witnesses for Jack Hansen-Bartel has received any notification of court proceedings, says Annie Hansen.

The last time Jack was at Koh Samui court officials made a point of banging him up in a cell below the court and allowing the American Chinese to enjoy the incident. ..it goes on and on.

To the cynic it seems that at worst what will happen to the American-Chinese is that they may receive a small fine.  There will be no grilling in court of their stories.  

And as for Tiffany Turner her father had announced they she would not be attending any trial anyway.

And Raymond Chang? He told ABC Australia: “Ms. Hansen demanded that we pay her 10 million Thai baht or else she would make sure that the boys 'rot in jail".

This is fiercely denied by Annie Hansen.  And in fact not only the figure – but the accompanying threat.

I can assure the conversation about money was nothing like the father said and I have a witness and a transcript of that meeting. and my yelling out ‘rot in hell’ unequivocally never happened either. We do not support verbal violence especially against such a sinister, scary and overpowering man such as Raymond Nobu.”

And behind the scenes apparently working on the side of the Chinese-Americans is a former Regional Police Chief General Pichit Kuandhethakop, who apparently wields a lot of influence in the area.
In cases like this, where corruption is suspected, there will never be any receipts. And of course complaining to the Samui court is not going to produce any results.

But if the Public Anti-Corruption Commission finds that corruption did take place – then a case can well be taken out in the United States.

But first lawyers want to know what happens in December.

Said Lada: “I am trying to fix all problems created by a past lawyer but I don't want to make my clients stressful. I need to see what happens with the current case – then I can continue carefully step by step.”

WILL ALL BE REVEALED AT PATTAYA COURT TOMORROW?

Despite receiving multiple threats Alastair Cooper will tomorrow turn up at Pattaya Provincial Court to challenge a case brought against him under Thailand’s feudal ‘Computer Crime Act – for sharing a Facebook page.




The plaintiff is of course fake lawyer Drew Walter Noyes who has gone to the United States taking with him 3 out of his nine children in Thailand and sending for two more – while on bail appealing a two year jail sentence for extortion.

Last week he failed to turn up on the 15th the day designated when he should surrender to his bail and was tweeting that two more children by his co-defendant Wanrapa Boonsu had also now gone international.

Noyes is believed to have based himself in his step-mothers house in Knoxville and has been looking up old friends to tell them of the time when he was an influential property dealer in Thailand where you ‘can have as many wives as you want.’

Cooper meanwhile has been receiving more threats from Noyes and Noyes’ colleague Brian Goudie saying that if he turns up at the court he will be immediately arrested on an emergency warrant to face charges of internet harassment.

This is course ironic coming from Goudie, born Brian Goldie, who has been jailed for three years for posing as a barrister and former officer in the Royal Marines to cheat a 78-year-woman out of some US$300,000 and who has created umpteen blog sites – including CasewatchAsia – to harass his enemies.

He himself has to surrender to bail next month on several more cases including one of the Thai equivalent of revenge porn.

Its alleged that he put obscene photographs of an ex-girlfriend and assistant on the net - after their relationship ended badly

Unusually a threat too was made by Wanrapa Boonsu who is due in court again with Noyes on Friday to hear the result of the appeal against the conviction with Noyes of trying to extort 7 million baht out of Michel Goulet of the Thonglor clinic, Jomtien, when they were running the Pattaya Times newspaper – a newspaper I am proud to have finally put to bed for the last time.

Wanrapa complains that Ally’s use of a picture of Oui Jirapun, his latest 19-year-old girlfriend is a flagrant breach of copyright.  However it is not her copyright of course.  But I’m guessing here that old lags need to stick together.  While Goudie was banged up Oui was busy telling everyone that he had gone on business to Koh Samui.

Wanrapa is also playing the supportive common-law wife role to Noyes no doubt because he has transferred all his ill gotten properties and pseudo companies in Pattaya to her name.

That may be to ensure that he qualifies for welfare for himself and his children in Tennessee.

Ally’s crime was to share this story from this site that Noyes was suing the owner of the website ‘SubZeroSiam’ for publishing a picture of him with Goudie which was photo-shopped to make them appear as if they were taking part in a gay parade Noyes wearing a leather pouch and Goudie wearing bottomless leather pants.

Unusually Noyes who had the court send the summons to a hotel which Cooper had once stayed at, was also given a public summons which means the summons is published in some magazine Cooper does not read.  Such is the system in Pattaya.

Noyes is not suing for the words which did not suggest he was gay at all – after all with that many kids and accusations of sexual harassment of women – how could anyone believe it all.

Noyes was purely suing over the photo-shopped pictures. He rather missed the point.  These pictures show Noyes as a man who is ‘all mouth and no trousers’ or in Glasgow ‘ All fur coat and nae knickers’.

He did however boast that he was the proprietor of the biggest gay magazine in Thailand.

Two angry Scotsman – one a convicted fraudster and the other a former brothel owner in Melbourne  - were escorted by police off the premises of Pattaya Provincial Court today after abusing a Brit who had taken up the challenge to rid the city of what he called ‘The Three Stooges’

Brian Goudie, 48, from Falkirk and David Hanks, from Girvan. Ayrshire, were first removed by the judge from court No.3 who told that that if they misbehaved in the building they would be caught on CCTV.

A third person, Wanrapa Boonsu, the common-law-wife of Drew Walter Noyes, left the court voluntarily.

She and Noyes are due in court on Friday to hear their judgment of their appeal against a two year jail sentence for extortion.


But Noyes is unlikely to make an appearance - not unless he has his own personal jet to get him from his sister's house in Lakewood Drive, Jefferson City, Tennessee.

They had all turned up for the case of Drew Walter Noyes against Alastair Cooper, 40, from Hull, an oil rig supervisor, for sharing on Facebook a link to a story about Noyes and Goudie on this site.
Said Cooper:

“I had received multiple threats that I was going to be arrested today. They never materialised so I guess they were trying to scare me from the going to the court.

“After I arrived I saw Goudie and Hanks wandering about the court.  They started cussing and blinding. If was F…! this and C..! that.

“Their faces were contorted and they did not look well..not well at all.  Hanks had begun by pushing his face up against the glass panel in the door of the court and mouthing obscenities.

"Outside the court they tried to bully my wife by saying she was going to jail."

"They're just bullies. They do not scare me.. I believe talking to people at the court, that people there are getting rather sick of them."

Brian Goudie was jailed in Australia for fraud after which he relocated to Thailand claiming to be a British barrister.

He is on bail appealing a 3 year jail sentence for cheating a 78-year-old woman out of some US$300,000 which included pocketing her son’s bail money.

David Hanks’ only claim to fame appears to have been as the owner of the Masquerades brothel in Keysborough, near Melbourne.

The ‘Three Stooges’  - Noyes, Hanks, and Goudie, have all been widely accused of scamming tourists and expats out of their cash in Pattaya.

Lawyers for Cooper began by saying that the summons was not legally sent.  It was delivered to a hotel in Khon Kaen in which he had not stayed.  No summons was sent to his true address in Thailand,  which he had signed for.

The case was adjourned  for the plaintiff to explain – and the court gave Cooper a full year without having to return to the court to seek documents to submneit to the Immigration Department.  The plaintiff Noyes had failed to appear.

The two Scotsman did not hang around the court where they had promised to have Cooper arrested,

"MY PATTAYA CORRUPTION HELL' - BY THOR HALLAND - THE ANIMAL RESCUE GUY

Thor Halland, a former officer in the Scots Guards and contestant in the winning Birkbeck College team on BBC’s University Challenge in 2003 claims he was set up for a three month spell in a Thai prison on false charges by a phony lawyer,  immigration police and a rogue foreign police volunteer assistant.

He named the phony lawyer as Drew Noyes, Pattaya Immigration * department and former police volunteer Jesper Kongerskov.

Drew Noyes bore a grudge believing Halland a former colleague in the Pattaya City Expats Club, had set up ‘Noyeswatch’ the first website to describe the phony American lawyer as a sociopath and a Walter Mitty.
This happened after Noyes’ shenanigans trying to sell subsidized house for poor Thais to club members and foreign tourists while both were members of the Pattaya , claims Halland.

And Noyes called in favours from immigration after Frenchman Laurent Thierry ran to him with complaints that he was being blackmailed by Halland and Russian mafia.

Kongerskov* was simply lining his own pockets with a well-known lawyer’s assistant known for ripping off foreigners in bail deals.

The alleged victim was Frenchman Laurent Thierry, an associate of Noyes, who runs a Halal food business in Pattaya. Halland was accused of theft and demanding with menaces.

And the Pattaya Immigration officers were seduced into the arrest by Noyes. Immigrant bosses in Pattaya had repeatedly rejected claims that Noyes was a convicted criminal who had been exposed for fraud in the United States.

Halland, who was setting up a television production company to film his 'Thailand Animal Rescue' spent three months in jail. Needless to say the production company and TAR have folded.

“My arrest was all a complete and utter fabrication" said Stowe College educated Halland who rented a television studio in premises also occupied by Thierry and Ivan Schiffer **, a Brazilian (featured earlier on this site)

 “The Frenchman, a man with a drugs history, was the thief and all I was doing was demanding my property back.  He stole goods from my studio including two computers, two sets of professional lights and a camera.

In the beginning of this year I had set up a small studio in Soi Bongkot, Pattaya in a shop house mainly being used as a factory by Ivan Schiffer. It was set up with a Green screen for making TV shows.  
In March I got an urgent phone call from Ivan who said that everything had been stolen by Lauren Thierry and gave me the address of a friend of his who would know where he was. 
I went immediately to the friend who informed me that Lauren was on his way. I was accompanied by Natalia, a Russian friend of mine,  plus two friends of hers Sergei and Denis who just arrived as well. 
Lauren immediately admitted to taking the stuff and I told him I wanted it all back and we wouldn’t go to the police. Lauren drove us in his car to his factory and gave me some lights and then back home where he handed over a couple of computers to Ivan which Ivan said I could keep. 
 Thierry agreed to give me a second computer the next day which I was to return to Ivan when Ivan came back from Brazil. A very expensive camera could not be found and Lauren agreed to pay me back over a few weeks. The next day he gave me the other computer and promised the money later. At no point was anyone touched let alone assaulted. 
Denis one of the Russians then decided he was going to collect the money after demanding 15000 baht for ‘services’ then took 50,000 baht from Lauren which he just kept. He decided he wanted even more money form me for ‘investment’ and I refused and broke contact. I wrote off the money for the camera and bought a new one. 
Out of the blue I was arrested on the morning of Wednesday 23rd of March and taken to immigration and then to Banglamuang police station. At no time was I interviewed or questioned in any way.  I was just held until I was taken to the court two days later where, once again, I saw no one and was not able to make a bail application and was just sent straight to prison. 
I arrived in Nong Plalai that evening and exposed to the full horrors of it. One guy had smuggled a mobile phone in which was discovered and the guards then started to beat him with clubs until he was a bloody mess. 
I was put in a room with 30 people and told to sleep on a concrete floor with only one blanket 
Next day I linked up with some English guys who told me that Mo was a rip off artist.
No one came to see me for a week then a friend appeared on the first Friday followed by my wife and someone I had known for 5 years ‘Jesper’ and the corrupt fake lawyer ‘Mo’ . They promised they would be bailing me immediately.
 
“After three days l was called to court but the bail application failed. Mo appeared not to care, in fact he had present applications that were appallingly written and guaranteed to fail. Drew Noyes had also stuck his oar in. 
The following week Jesper then claimed that the police would drop the whole issue for 250,000 baht. My wife paid the money but then it was all apparently cancelled and the police, he said, kept the money. A further million was demanded by Mo to cancel the case. 
Mo and Jesper then tried to get me to sign away my house into Jesper’s name. By this time I was realising that Jesper was lying to me and that Drew Noyes was behind him.
After two months I got myself a new lawyer and my father and friends from the US were helping me out.  After 100 days I finally got bail sorted out a few issues then friends of mine smuggled me over the border.
 
The Russian guy in my case Denis Zabadoev just latched himself onto me through a mutual friend claimed to help get stuff back then just extorted me every week.  He attacked me several times in jail and demanded I pay him 5000 bath a month and bail money as well as compensation for time inside at 50,000 a week.”

Halland’s account of the case clearly indicates that there was a financial dispute between Thierry and Halland – cases which Pattaya Police and Thai police as a rule are loathe to deal with.

But no sooner had Halland been arrested than both Noyes and Goudie were putting accounts on all their websites.

“Thai Immigration Police arrest expat Thor Halland in Thailand on kidnapping and extortion charges.”

“Following Pattaya Court issuing the arrest warrants Thierry says Pattaya police were unable to locate Halland or Zabodaev, and as a result engaged One Stop Legal Services to locate these dangerous offenders. 
Pattaya Immigration office was supplied early this week with information from One Stop Legal Services which then allowed Police Colonel Prapansak, Superintendent of Pattaya Immigration, to arrest Halland and Zabodaev.”

Jesper Kongerskov has also been named in the attempted shake down of a US citizen who was falsely arrested on child sex abuse charges.
Ivan Schiffer was a former journalist on Drew Noyes’ Pattaya Times. He was deported after Drew Noyes reported him for over-staying. Story here. and here

CAN I STAY IN THE U.S FOR XMAS?

Con man Drew Noyes, the American phony lawyer, and self-appointed international advisor to the Mayor of the seamy Thai resort of Pattaya made an astonishing plea to the Thai appeal court today.

“Please can you tell me the result of my extortion appeal before I return”, he begged judges in Pattaya through his lawyers, asking to see if his conviction and two year jail sentencehad been overruled.

This was an unlikely scenario as he was the subject of a police sting operation.  But judges refused to read the result without Noyes present anyway,

His common-law wife Wanrapa Boonsu the majority owner of the Pattaya Times newspaper which Noyes published was at the court – along with his ex-wife Nittaya Chaisit , who Noyes had announced was going to America to look after the children by him.

She was there to tell the court she was 'getting' an American visa to go and look after her children.

(#DrewNoyes never applied for a Green Card for her when they were married but put property in her name in North Carolina - then got Nittaya (who is illiterate in English and Thai)  to sign a Power of Attorney over to him)

Repeated claims on Facebook and Twitter that he was returning to Thailand for his acquittal were of course a sham.

An attempt to mediate was made at the last minute.  This was also an irregular situation as the case was a joint prosecution by police and Goulet.

Lawyers for Michel Goulet and the Thonglor Beauty Clinic in Pattaya categorically refused.

Drew Noyes had tried to take them down for 7 million Thai baht – telling Michel Goulet that if he did not cough up his premises would be raided, illegal substances would be found, and he would receiving damning publicity in the Pattaya Times– a newspaper Drew Noyes had set up to attack his enemies and promote his ‘legal service’ for foreigners.

Noyes defence appeared to be that there was some sort of conspiracy against him. The cash requested was only for advertising in the Pattaya Times.

Noyes told lawyers he could not appear as he was settling his children in the United States.

It is believed he has taken five of seven children by Wanrapa Boonsu and Nittaya Chaisit.  However one of Chaisit’s children refused to go, and one of Wanrapa’s younger children also stayed.

Noyes left behind another daughter– by a former employee at his One Stop Service Center, and made no claim on a child it is reported  he had by Nittaya’s  14-year-old niece.


Noyes’ long range of scams on tourists and expats in Pattaya appears to be now at an end.  In a resort known for its corruption he easily made friends with judges, police colonels, army generals,  and immigration officials – and had some success in using these contacts to breathe fire on his enemies.

He made no secret of liking the sex resort in Pattaya and the availability of young women for sex and the opportunity to have several wives.  For shorter arrangements  he had a room which he called ‘The Bat Cave’ in Jomtien for sexual liaisons.

He also let out the room which had a dancing pole at the head of the bed to expat friends for favours.

His scams were frequently exposed on this site.  They included conning expats into putting their property in Wanrapa’s name (because it is safer with my Thai wife than yours), sold subsidized housing built for poor Thais to foreign tourists and expats, employed Filipinas whom he had chatted up on social media.

He then fired them when they refused to have sex, Drew Noyes also claimed, falsely, to be an American lawyer, and a member of MENSA

One of his final coup's was to get himself elected at President of the Silom 310D Branch of the Lions Club with his then girlfriend Naam elected a Secretary of the predominantly Indian chapter.

He frequently claimed Royal connections and traipsed along to the Army Club in Bangkok with members to demonsrate his military ones.

But when his legal cases went wrong and the clients complained he shut them up by threatening to sue them under Thailand’s’ libel laws.

He took multiple cases out against us here at this site but only won one – and that was not for anything written in a report – but a comment by a reader that both Noyes and David Hanks one of his henchmen, were ‘pimps’.

Hanks was of course the former owner of a brothel in Melbourne, and Drew Noyes originally ran to beer bars called ‘Zebra’ and ‘Lollipop’ – but of course technically these bars do not sell women in Thailand – That would be against the law.

He has now returned to Jefferson City, Tennessee and is believed to be staying with his elder sister.

The man who claimed he had come to Thailand by Royal Proclamation and described himself as the most 're-assuring and credible businessman you could meet in Thailand' has been sent on his way after paying a tidy sum in bail. That way the problem of Noyes is taken away from Thai shores.

A warrant for his arrest will be issued on November 25th if he does not return. Could he not stay in the US to have Christmas with his kids?  No, the judge replied.

But it appears even at the last minute he was scamming.  In the court today his lawyers took a call from his bail bondsman, believed to be a personal friend.   The person had to be told that Drew had not turned up. Noyes' lawyer could have added  ‘ as expected’.

The “Bat Cave’ I understand has been sold.  Pattaya’s most notorious American sex tourist is not coming back.
