IS NET CLOSING IN SERIAL FRAUDSTER POSING AS OFFICER AND GENTLEMAN?


Scot Brian Goudie, formerly known as Goldie,has been spotted out shopping in Siam Paragon, Bangkok, after vacating his 'Key Bar' in Pattaya when a warrant for his arrest was issued.

The phony British barrister was spotted this afternoon at Siam Paragon with his latest Thai girlfriend Oui Jirapan studying menus in the restaurant section.

The arrest warrant was issued by Pattaya Provincial Court on a number of charges, which include fraud and 'revenge porn'.

The revenge porn relates to video and photographs widely distributed over the net showing a previous 'assistant' to his alleged law company Alba Laws providing him with a sexual service.


Goudie, originally from Falkirk, the son of a Scottish labourer, is also on bail and appealing a three year prison sentence for cheating 78-year-old Barbara Fanelli Miller, from \Madison, Wisconsin out of 7.8 million Thai baht.(US$220,000 although laywers say a more accurate figure would be over US$300,000).

Part of that figure was some 400,000 baht in bail for Barbara Miller's son - who subsequently died in custody without proper treatment for an existing heart condition.

Goudie later claimed that his client Greg Miller was a cheating 'perv' and it was he who was trying to bribe the authorities.


The 'revenge porn' charges have been brought by Goudie by a woman known as 'Nang' whom he had appointed as Managing Director of a company called 'Jimi International' which he Goudie had acquired from former Ulster Jimmy drugs trafficker  'Doc' Halliday.

All Halliday's assets in the UK has been seized under the Proceeds of Crime Act, but he had the 'Blarney Stone' pub in Pattaya and two apartments which he allegedly signed over by thumbprint to Goudie, while in custody in Pattaya and dying of the flesh eating disease necrotising fasciitis.

Goudie changed the name of the bar and guest house in the Jomtien Complex to the Jaggie Thistle and put the deeds in the name of 'Nang' the day after it was raided and found not to have rhe right licences.  He later wrote on his website CasewatchAsia that Nang was running a brothel.

He has now transferred control of the premises (in name anyway) to his latest girlfriend Oui Jirapan from Surin pictured with him.

Prior to arriving in Thailand a warrtant for his arrest had been issued for him by Scottish Police for an alleged fraud on the Royal Bank of Scotland. It was later withdrawn having timed out.

And he was convicted and jailed for 6 years by judges in Perth, West Australia, for stealing some AUS$400,000 from a West Australian mining company.

He re-invented himself and arrived in Thailand declaring he was a British bartister and former officer in the Royal Marines. He of course lied about his law degree and his military status - though he had been a weekend sailor.

More recently he was the subject of the documentary 'Brian Goldie - Scottish swindler' - by Makeworld Productions.

BUT NO THANKS TO PATTAYA JUSTICE

A British oil platform superintendent who took on Drew Noyes, a phony American lawyer who set up a business making cash out of foreigners in Thailand, was today formally acquitted of libel at Pattaya Provincial Court.

Ally Cooper’s alleged crime was to share a link on Facebook relating to a story that Noyes, a notorious con man , was suing the alleged administrator of an English language forum in Thailand for libel.

It was a shameful  performance by the court in Pattaya with which Noyes, posing as a lawyer and local newspaper publisher, had had a close relationship.

In fact all Cooper did was share an internet UR on Facebook.  Not only that the summons was issued to him at a hotel in Khon Kaen when not only was there water-tight evidence that he was somewhere else at the time, but also the hotel manager remembered seeing the summons and returning it because the alleged customer was not there.

The issuing of summonses is entirely the responsibility of the court and not of the Thai postal service.


Despite that the court accepted the case and Cooper, originally from Hull, who head about the case on the net, was forced to pay bail and unable to leave the country rendering him out of work for a year.

The report which Goudie linked was a report on this site stating that Drew Noyes was suing the web forum SubZeroSiam for libel for publishing a photo-shopped picture of Noyes,  then owner of Spice gay magazine, in a gay parade.

The picture was quite clearly satirical as Noyes is known as a promiscuous heterosexual, with a history of sexual harassment of women,.

I was also enjoined in the action. I also received no summons to attend the proceedings, despite my address being documented with Immigration Police, the Public Relations Department, Department of Labour, and Ministry of Foreign Affairs.  That case was continued sine die.

Drew Noyes left for America with the permission of Pattaya Court after being convicted together with Wanrapa Boonsu of attempting to extort the Thonglor Clinic Pattaya out of 7 million baht – on pain of a police raid on his premises – when presumably illegal medications would be found, and bad publicity in Noyes’ Pattaya Times. He was arrested after the owners tipped off police and was arrested when he accepted the first 100,000 baht.

Noyes and Wanrapa were sentenced to only two years in jail. They appealed but have repeatedly refused to turn up to hear the result of the appeal judgment. Normally on appeal hearings it is one strike and you’re out.

But Wanrapa and Noyes have repeatedly delayed the process. Wanrapa Boonsu  has been off ‘sick’ twice and Noyes has been unable to return for ‘family’ reasons.

All told, they have delayed the judgment for over six months.  Finally an arrest warrant was issued for Noyes and earlier this month an arrest warrant was issued for Boonsu .  The judgment will now be read on April 7th.

Noyes lawyer has said he will return for the judgment then.

If he does then his acquittal must have been arranged.

Despite his ordeal Ally Cooper was upbeat: "It was worth every single penny. It's taken a huge toll on my family, especially my wife. It sends a clear message that honest decent hard working individuals will not be bullied out of opposing crooks and thugs. Drew Noyes will spend the rest of his life out of Thailand. Brian Goldie* is next for prison or fleeing."

ESCAPED FROM THAILAND - TOURIST JAILED WITHOUT TRIAL

ANONYMOUS GROUP BREAKS OUT YOUNG NEW ZEALANDER  IMPRISONED WITHOUT SEEING A LAWYER, INTERPRETER OR EVEN JUDGE - AND 'POLICE LIED'.

A young New Zealand tourist, who was jailed without entering a plea and without seeing a judge, has escaped Thailand and is now safely black home – a clandestine group calling itself ‘Lifeline’ has confirmed.

The tourist who had been touring Thailand and Burma had been jailed for six months by a judge in Phuket even though the 23-year-old had not been  offered an interpreter, not gone before a judge, and not been able the chance to enter a court plea.

A spokesman for Lifeline, the organization which arranged his departure from Thailand through an unspecified country said:

 “We are pleased to announce that ‘x’ has made it to the safety of Australia and onwards to New Zealand. He is home now. This is a service not for criminals but for victims of Thai injustice.”

The young New Zealander had claimed he had been robbed in Bangkok but had no time to report it as he was leaving the following day to Burma. The Bangkok hostel had confirmed the young man and others had had items stolen from them.

He committed the offence by reporting the theft in Phuket claiming, falsely that it happened there.

Phuket Police allegedly told him not to worry. He would be charged with a misdemeanor and be fined the following morning in court and allowed to leave after paying his fine.

Said his mother:
 “Paper work was completed by the police, and then he was asked to sign a confession written in Thai.  
 

“If he had any idea a prison sentence was to be imposed, he would have asked for a lawyer and an interpreter immediately and also asked to contact the embassy. None of these basic rights were provided and he was essentially lied to by the arresting officer.
“He was told he would need to spend the night in the police cell and go before a judge at court.
 
“The next morning he was taken to the court cell just expecting to go before a judge to pay a fine and then be released 
“Whilst waiting in the cell, a court official who spoke broken English came and explicitly told him to sign some more papers so they could assess his fine.  They were written in Thai and he was essentially lied to by the court official.   
At this stage, he had no reason not to believe the police officer and the court official and waited to go before the judge.  Little did he know that the police and judicial system in Thailand are corrupt and a law unto themselves. 
“He never saw any judge and a court official came back to the cell and said “you have been sentenced to 6 months prison”.  
“He immediately panicked and asked questions but the official ignored him saying he didn’t understand English. He was thrown straight into prison without any rights to call a lawyer, Embassy or make any outside contact whatsoever.   
"He was also not given any paper work as to the sentencing.  When he arrived at the prison cell, the administrator there asked where his paper work was but of course he was given nothing.”
How Sudra's arrest was reported locally. No bags arriving at his hotel???  His version was more credible.
A judge was forced to agree.
The family heard about his imprisonment a week later when a newly released prisoner notified the New Zealand Embassy.

In a similar case reported on this site Briton Jaysukh (Jason) Sudra was banged up in prison in Pattaya for allegedly making a false statement to police to collect insurance money.  Mr. Sudra did not have an insurance policy to cover theft, only a medical policy.



He too was jailed without seeing the inside of a court. Jason’s daughter Sinita has written a testimonial to this site.  The judge later ordered his release.

In the case of the New Zealander the family had to be guided away from lawyers notorious for collecting payments for bail and pocketing them. The family had to pay 180,000 bail to get him out of prison.

Has Richard Barrow, the most prolific full time blogger in Thailand turned?

I was shocked to read on Twitter yesterday that former schoolteacher Richard seems to be less enamoured with Thailand the 'Land of Smiles'.

This message seemed to come with a pronounced frown:



If anyone could have convinced you that Thailand was indeed a paradise then Richard could. He has blogged from just about everywhere in Thailand recording the countries festivals, displaying plates of delicious Thai delicacies, phOtographing stunning beaches, waterfalls, and in the last few years giving us stunning views from his drone of not only of beauty spots - but political rallies.

He seemed totally at peace with the country. Now he says:
"I'm sorry Thailand. You're not that paradise you once were? I now wonder. If I had arrived here today, would I have stayed? Maybe not."

Actually there is not shortage of people who still arrive and want to stay. And if I arrived for the first time I am sure I would also be impressed. Everyone I am sure has their perfect moment.

Many of those too later have their  'What the F...!' moment.

I am not sure what was behind Richard's mind when he wrote that. 

Could it have been this:


Yes this is Phi Phi Island which is allegedly 'protected' , above as it was when I, and probably also Richard, arrived in Thailand - and below more recently. 

I am not sure if this is a 'Road to Damascus' moment for Richard, just probably the first time I have noticed that he feels the place is not quite what it's upped to be,

As a career journalist after an initial wild infatuation, when I thought my Thai landlady was mad saying she preferred the UK, I had my Damascus moment a long long time ago but continued to enjoy the delights which the country afforded me when I kept my head down. 

The prison and justice system did it for me I guess. If you look at that for any serious length of time you cannot but come to the conclusion that like the jails - which have manicured lawns and meticulously kept flowerbeds on the outside - there is also a very bad smell and a strong lack of humanity.

After a while you just cannot overlook it.

Actually I thought when Richard start blogging about Thai Prison Life' I would see a radical change in his upbeat blogs.

Still Richard's 'moment'  so to speak may be just that. He's been back up again and now presents us with a 'Hooters' picture and gone is that momentary depression.


'Hooters' - 'an American Sports bar & grill chain famous for 

chicken wings served by waitresses in short shorts' - 

has closed down 36 of its 37 outlets in Britain.


Presumably the idea was not so commercial. The Daily Mail 

previewed the remaining restaurant in Nottingham under the 

headline: 'Is this the most offensive bar in Britain?'


That's how sensitive we are in Britain at the moment. People date 

by APP.  That way, I suspect,  they can lay the ground work and 

cut the risk of sexual harassment.


Are we still prude?  Not judging by the television. I turned on the 

TV a week or so ago to watch a couple on a sofa asking for advice 

on anal sex and then being given an illustrated talk on butt plugs.


A physical demonstration would have been perfectly in order.


Last night two gays demonstrated their kink - a puppy love fetish.


I'm not going to into that.

HOWARD MILLER CALLS IT A DAY - 
BUT HE HAD A 'BLAST'.

Thailand’s most famous Foreign Tourist Policeman – and former Honorary British Consul Howard Miller has announced he has returned home to Britain after selling up his assets.

Howard Miller, who shot to mild fame after featuring over and over again in the controversial television series: ‘Big Trouble in Tourist Thailand’ has thanked his friends and told them it was time go to – but he had ‘had a blast’, he said.

From Southend-on-Sea Miller took up residence in the Thai resort of Pattaya 14 years ago, at about the same time a close friend started up ‘Secrets A-Go-Go’.

He became Group Leader of the Tourist Police Volunteer Assistants and was able to get along with Thais and foreigners alike and was used to anchor threads on the fly on the wall series which aired on Bravo and Sky in the UK and in other countries around the world.



The series caused some controversy particularly after it exposed scams in Thailand, notably a jet ski scam in Phuket and a gold scam in Pattaya.  Miller however steered Pattaya out of the worst controversy but the film producers were more than happy with the continuing flow of ‘idiots abroad’ – in this case Brits.

He was shortly afterwards taken on as Britain’s Honorary Consul, a post he held until the Foreign Office decide to revamp the post – reportedly the consular department’s busiest,  to his disliking.

He bounced back quickly into the limelight with his continuing interest in his media outlet ‘Pattaya City News’,  which had morphed into Pattaya One, and by going into the  ‘go-go’ bar and property businesses.

With the nature of go-go bars being what they are and I guess expecting the headline ‘Her Majesty’s Vice Consul! ‘ in a red top newspaper back home, he duly sent this site photographs of himself and his co-owners in his first go-go bar venture in ‘Little Britain’ – an enclave in Pattaya known for characters similar to ‘Lou and Andy’ from the British television series.



In a farewell note sent from Suvarnabhumi airport Bangkok and published on the Teakdoor Forum Howard states:

 “After 14 years in Thailand I am now returning to the UK to pursue new interests.
 
This may come as a surprise to some but I wanted to leave quietly with no fuss. I do not regret my years in Thailand and have thoroughly enjoyed my Thai experience and will miss good friends I have made, but the time is right for me to move on after successfully liquidating all my assets.  
New challenges lay ahead for me and I am sure it will not be plain sailing but I am ready for the move and looking forward to it. 
I wish everyone I have met over the years in Thailand the very best for the future and the new team in place at Pattaya One will definitely take the brand from strength to strength and exciting times are ahead for Pattaya's leading news service.  
All the best Thailand..... It's been a blast!!!!”

SEAMAN KILLED BY ANCHOR CHAIN


A 38-year old Bulgarian deckhand died after an anchor chain almost cut his body in two on the ‘Ocean Victory’ superyacht of Russian oligarch and billionaire Victor Rashnikov in the Similan Islands off Thailand today.

The Bulgarian got caught up in the chain when it was being lowered off  Koh Tachai , the Thai newspaper Sod quoted Petty Officer First Class Watcharin Promruang of the Royal Thai Navy as saying.

There is unlikely to be an enquiry.

Rashnikov, Chairman of the Board of Magnitogorsk Metallurgical Combine, is said to be a keen water skier and scuba diver and close friend of Vladimir Putin.




He has been involved in a number of controversies particular in relation to how he bought the company, having risen from a mechanic, and also into the manipulation of workers’ shares. He is ranked in the top 200 richest people in the world.

The Ocean Victory has been described as the largest and most advanced yacht ever built in an Italian shipyard.  It has seven decks, six pools  and an internal floatable dock for a 14-metre tender.

FULL ARREST WARRANTS NOW ISSUED - BUT AS THAI JUSTICE CHURNS AND CREAKS IS IT TIME TO CALL IN THE WALKING DEAD?

In the light of arrests warrant issued against them  the bosses of Pattaya One Stop Service Center have been reducing their profile on the internet – along with their colleague in villainy our famous fake lawyer from Scotland.


Drew Walter Noyes, Wanrapa Boonsu, and Brian Goudie, aka Brian Goldie deleting and stripping websites following arrests warrant for all three of them now, belatedly issued by Pattaya Provincial Court.

Goudie's Facebook page is down, but Noyes's Facebook page which was down has been restored today.

Drew Noyes has of course long since fled to the United States, and, as he perhaps had little fear of arrest across the pond for their for crimes in Thailand (both he and his common law wife were sentenced to two years in jail for extortion),  this may suggest he also does not want the US authorities to give him grief.


One of his last messages on his Facebook page and Twitter was to promise his former nanny that he would soon return to see his newborn son….his ninth child by a Thai woman.

Noyes and Boonsu repeatedly failed to turn up to hear the result of their appeal into conviction of attempting to extort the Thonglor beauty clinic in Jomtien out of 7 million Thai baht – on pain of a police raid and subsequent bad publicity in their now defunct ‘newspaper’ the ‘Pattaya Times’.




The result of the appeal will be read next month regardless.
Brian Goudie is in an even worse position. He has been convicted of embezzlement and fraud and is appealing a three year jail sentence.

But not only that a warrant of arrest has been issued against him for fraud and ‘revenge porn’ related charges and strong objections have been presented for refusing any possibility of bail.  The court has confiscated his passport.

Both Noyes and Goudie of course are known as ‘runners’.   Noyes fled from the United States after being exposed in the Star in Wilmington, North Carolina, as a man of ‘myriad lies’ with a history of share and property fraud, and sexual  harassment.  He also had an FBI felony record.

He arrived in Thailand announcing that he was a lawyer and ‘the most credible re-assuring American businessman’ you could wish to meet and promoted his image as also a publisher,  ardent Royalist,  sharp shooting, parachuting, charity donating, problem fixing, do it all. He also claimed he was FBI cleared.

Goudie, under the name Goldie, fled from Scotland shortly before a warrant of arrest was issued against him for defrauding the Royal Bank of Scotland (his employer).  He settled in Australia where he was convicted and jailed for six years for defrauding a Perth mining company ( his employer).


He arrived in Thailand, skipping a hearing of the Australian Administrative Appeals Tribunal, which almost certainly would have ordered his deportation, and announced he was a British barrister and former officer in the Royal Marines, setting up a company called Alba Laws. 

He sought clients in Thai jails promising them all freedom at a cost.
On this site we called their bluffs. Despite multiple libel actions and  concerted internet campaigns against their enemies, all of whom they labelled criminals, even the court in Pattaya has now been forced to act.

Finally, David Hanks, from Girvan, Ayrshire, Scotland. the gofer for both Noyes and Goudie, has returned to Australia and told Pattaya court he is sufferings 'bacterial condition'.  This is a new one. Noyes and Wanrapa have collectively claimed, jet lag, just sick and even hemmorrhoids. Hanks apparently faces charges on his return in connection with Noyes' extortion.


GOSSIP: Back in London two victims of Drew Noyes last night prematurely celebrated their victory over Noyes. I say prematurely because total victory would require these people to be locked up.

They are electrical engineer Ally Cooper and former  University Challenge contestant Thor Halland who cracked open a few bottles of champagne. 

Halland had been recently as a zombie in some sort of  Night of the Living Dead production and Cooper informs me that not much make-up was required. He has sent the picture below to demonstrate his point.



Footnote:  Noyes and Boonsu have not closed down their Onbe Stop Service Center site and Noyes has been continuing to 'advise' from the US.  Below is a video of a 'satisfied' Brit called Keith (he does not give his full name not surprisingly) who says thanks to Noyes he has now got control of his own property by forming a company.  (Is anybody going to tell him?)

HE WAS CHARGED WITH CHILD SEX ABUSE BEFORE.

BUT FAKE 'IMMIGRATION LAWYER' WAS ALLOWED TO WALK FREE FROM 27 YEAR SENTENCE


A fake American immigration lawyer has fled a 27 year jail term for child sexual abuse after paying 400,000 Thai baht (US$11,361) in bail to Pattaya Provincial Court.

Brian Edward Wright, 59, had been found guilty of the repeated rape of a 12-year-old girl prior to his arrest in 2012.



The Thai Immigration Department said today that Wright had not passed through a border control checkpoint – but it seems unlikely, with his claimed immigration contacts and such a heavy sentence over his head, that he has remained in Thailand.


An arrest warrant has been issued. Should he return to the United States he would face extradition back to Thailand.

Wright from Rhode Island was also wanted for questioning over the sexual abuse of a child in Providence, Rhode Island in 1995 before he fled to Thailand.   

On October 28 2014 he was sentence to 36 year imprisonment reduced by a quarter to 27 years on four counts of rape and four counts of taking away a child without the consent of her parents.

He appealed (Red file case 11066/ 2557) and paid the 400,000 baht bail but clearly had not intention to return.

Wright, a friend of and godfather to one of the children of Drew Noyes, for whom an arrest warrant has also been in his case for attempted extortion.

Noyes fled while on bail of 500,000 Thai baht.

Noyes who also posed as an American lawyer had attempted to obtain 7 million Thai baht from the owners of the Thong or Clinic in Justine on Thailand’s eastern seaboard – and threatened a police raid and bad publicity in his now defunct ‘Pattaya Times’ newspaper.

Questions have been asked about the paternity of a child mothered by the 14-year-old niece of Noyes’ Thai wife.

Wright cruised the bars in Bangkok and Pattaya with Noyes on days off when he was not running his company called USA Immigration Law with the website www.mythaifiancee.





He boasted that he had secured fiancée visas for high ranking US military men, police, lawyers, and secret service men.

Had ‘secret service men’ checked  they would have discovered that Wright skipped US$15,000 bail when , it is now confirmed, as a resident of Block Island, Rhode Island,  he was charged with first degree sexual assault of a minor child. 

In Thailand on his website he also claimed he donated to needy children through his company’s own ‘Thailand Children’s Charity Project’ displaying pictures of himself with children.

During his trial his company was taken over by a mysterious Braydan Hamilton, also a ‘US Immigration Lawyer’ who has flooded his first 3 pages of Google with promotions for the business, but, not surprisingly has no previous profile, or bio.

At the time of his arrest in Thailand a US Embassy spokesman said: 


"While we cannot comment on the specifics of this case, the United States values our cooperation with Thailand on law enforcement issues and cases, including this one."

No one was immediately available for comment. 


COMMENT: The fact that Drew Noyes, Wright’s buddy, should be given bail and even allowed to travel to the United States having been convicted and jailed on a serious extortion charge is bad enough. 

But Pattaya Court’s decision to let this man go is absolutely disgraceful and a total insult to the US-Thai agreements to co-operate to cut down on international child sexual abuse.
  
On an almost annual basis teams from the UK, Australia, United States and even Scandinavia meet with officials at all levels of the Thai Justice system.  They organize seminars, even hold parties in Embassies.  And the Thais agree to everything.  Brian Wright is not the first to go free. There have been dozens.  And there have been strong indications that money has been involved – not just money for bail.


At the same time there can be no doubts, as we have shown on this site, that innocent people can also be framed with scant regard to facts.  

This case is all the more galling in the knowledge that Pattaya Court, as reported here, has jailed people without trial, and held hearings without telling the defendants. 

Thailand needs to come out of the Third World. But while the country has malls and state of the art luxury goods, its justice system appears to be still in the dark ages with promises to reform….merely promises.

FLYING SPORRAN'S WEEKEND DIARY

Thailand’s military have given the ‘city fathers’ in the world’s most famous sex resort  of Pattaya six months to vacate their chairs at city hall.

The deadline runs out on June 16th when the ‘Flying Sporran’ officially goes into retirement and has sent rumbles throughout the resort on Thailand’s eastern seaboard.

A team of city fathers (elected by the military) will then take over but will they take on the mafia, or merely take them over?

Having removed the head - Mayor Ittiphol Khunpleum, son of mafia godfather Somchai Khunpluem - aka Kanman Poh - the military is understood to be following up with pincer movements on the sex trade and foreign mafias.

There is no suggestion the sex trade will be brought to an end. But it is expected various uniformed delegations will be seen inspecting premises to ensure no-one is being, er, trafficked.


A city hall spokesman recently attending a meeting of the Pattaya City Expats Club, told foreigners they need not worry.



‘We will still be around. And the police, tourist police, and immigration department, will still be there continuing their good work.”

The last statement will not have been of much cheer to foreigners who have watched the antics of these greedy organisations.  But of course its not true. 



The head of police is already a military appointee – Suktad Pumpanmuang.

He is the brother of Thailand’s outgoing police chief Police General Somyot Pumpanmuang, who having declared that his officers read from the same books as New Scotland Yard then retired as a newly made multi-millionaire.


One section of the community requiring considerable scrutiny is of course the group of foreign property developers in the resort.


Currently foreigners investing their life savings in holiday homes are now more at risk than ever as unscrupulous property developers take cash for projects which will never be built.





Developers have set up lavish showrooms and advertised glossy condo in the sun projects heavily on the internet but time after time the projects are being cancelled or simply not going ahead after the money rolls in from buyers.


They of course always have something or somebody else to blame. 


Currently it is the military government and the trickle of foreigners, likely to become a stream,  leaving the country – to perhaps be replaced by Chinese. They will not be criticising the military openly now.


Currently buyers, from Europe (including Britain), Russia, China, India, Australia, are all demanding their cash back on unbuilt projects.


They report that if they put out warnings on the net, they face libel law suits under Thailand’s Computer Crime Act.


Some have discovered in their paperwork two contracts which upon closer examination show how they have been criminally defrauded.


An original master contract which gives a guaranteed completion date or money back clause is switched at the last minute with one which has no completion date at all.


Then there can also be a clause to go to arbitration, not civil or criminal court, if the client considers the developer is in breach of the contract.  (buyers are not told that arbitration is super expensive and the costs can be as much as the condo being bought).





But if they have to take legal action it’s at this stage that they realise that legal action is going to cost them more than their small condo anyway and will take years in a judicial system which is both notoriously pliable and dysfunctional.


And even if a Thai court was to order they be repaid – the buyer would have to enforce the order too.


For decades both police and city officials have turned a blind eye to the scamming property developers who frequently hob nob with city officials and senior officers and vie with each other at annual Property Award ceremonies in Bangkok.


Police will not investigate property scams. But worse they have even been used to intimidate victims of property fraud.



Emerald Palace
The city’s Consumer Protection Office, serves only to protect some Thai victims. Readers of this site may recall an interview with one of them over the ‘Emerald Palace’ scam.

The officer suggested the city could deal with transgressors by simply eliminating them and taking them out into the Gulf of Thailand in a fast boat!



Haughton
Of course nothing happened in that case where Briton Richard Haughton running Harlequin (Thailand) then TPME sold scores of units in his condo – then sold them again to the Kasikorn Bank for a 79 million baht loan!

To ensure none of the scams get out the developers have essentially bought off all the local English language media.


Thus if victims of property rip-offs try to complain to a local English language newspaper – they will be quickly shown the door.


The local rags depend on the advertising from the so called developers for their very existence even though they know the scams.


In fact a very well-known local media personality even recently approached this site asking on the basis of friendship whether I could ‘lose’ a story on the new Scandinavian player in the property business in Pattaya.   The reason, he had a potentially lucrative media contract with them.



There is a certain irony in the fact that while Thailand’s military premier General Chanyuth Chan-Ocha is severely clamping down on foreign correspondents, journalists writing for the mafia remain as rich as their unchecked next advertising puff will allow them to be.

So now, if you still want to buy, let’s see what’s happening in the property market in Pattaya?   The market is dominated by Israeli managed companies, who have been known in the past to offer deals of 12 per cent to a massive 18 per cent to agents who sold their products.


This may account for the fact that every third foreign business in Pattaya appeared to be a law office or real estate agent. - a lot now going bust.


It also tells you something about the mark ups on property to foreigners. 


Here are some of the major players. Of course I am not saying any of the following groups are scamming. They may be at worst bad gamblers. But often its not their money and I am questioning whether some should be in the business at all.



THE NOVA GROUP


This group is widely known as one of the most professional of the Israeli companies. 

Projects normally come in on time. If not buyers have been refunded. In the last year for instance the Nova Group has cancelled highly publicised condo projects called Pacific Bay , Ocean Pacific, North Beach, Nam Talay Building B.


Also Nova principally owned by Israeli Rony Fineman seems to have ‘let go’ its entire condo staff.  This company is getting out of the condo business, towards hotels, and the buzz is that it is moving much of its cash out of Thailand.



Fineman boasts of being a mate of Robert Maxwell, the thieving former British newspaper tycoon who drowned after falling off his yacht  Ghislaine. 

He was the General Manager of Maxwell’s Restaurants based in Covent Garden, London. He has dual Irish-Israeli nationality.




THE TULIP GROUP


The Tulip Group is led by Israeli Kobi Elbaz, and other investors and, with the exception of the Centara Grand Resort which was running at 50 per cent occupancy, does not appear to have finished to any of its projects which include Waterfront, Centara Grand Condominiums Na Jomtien and Tulip Residences and Suites.



The Waterfront may have been this group’s undoing. I don’t know who they upset but all work has been stopped for a while, and City Hall has yet to issue a construction permit - hence their progress reports on their websites all seem to include photos of officials of one sort or another.



Nevertheless you can still buy a condo there and they are advertising on the net and denying media reports.






THE MATRIX GROUP


The Matrix Group of Israeli Miki Haim has the slogan: ‘We build our promises’  



At the moment still 'Pie in the Sky'.


But seemingly recently it has not built its promises and is late delivering ‘The Vision’ , The View, Sky Tower, while little work appears to be being done to finish some and start others.

So called completed Sunset Boulevard 1 & 2 have major construction faults, according to the buzz in the industry.



HEIGHTS HOLDINGS

Heights Holdings is run by Israeli Haim Bar-David & Herman

Van Gucht.  This group has 18 projects with real problems. Only a few have been finished. 


But on his Facebook page Haim  Bar-David is promising to complete 5000 units this year.

They are heavily advertising internationally. This may be the most controversial of all the development groups.



Heights Holdings have a number of court cases on their hands and others believed to be pending and complaints are appearing on the net in relation to how they conduct their business.

But they apparently have a 'pit-bull' lawyer.

Haim bar-David announces that he has to deliver 5000 units this year. 'Thats a crazy amount'

It is - and most should have been delivered last year I guess.

Belgium born Herman van Gucht has a ‘Dr.Death’ aura about him.


This relates to his time in the United States where he ran USA Real Estates Solutions in Florida before he departed for Thailand. 


There were accusations of that a representative of his company was forging title deeds to acquire the properties of dead people, mainly Belgian who had bought retirement homes in Florida.





Herman van Gucht, 65, is also in the courts in Pattaya for allegedly stealing the assets of investors who has invested in a project called Thaisiri.  In that case he has reported to have threatened his adversaries with the Computer Crime Act (libel).



His name is also of course associated with Town and Country Property (24.5 %) . Whispering Palms  49 %, Tropicana View- 47.5 % and with his wife Mayuree is linked to: The Cube, Peak Towers, Suan Sawan,The Residence Jomtien, Palm Oasis and Palm Springs Saranchol, La Royale and The Cove. He boasts he owned 1000 rai of land in the Pattaya area (through proxies of course)

Heights Holdings have a number of court cases on their hands and others believed to be pending.



POWERHOUSE

Powerhouse.  This is run by Jewish New Yorker June Bernard and is years behind in the development of Skylight and other projects have come in very late, if at all. 





Skylight was the subject of a section in a promo video by Capital TV’s Raine Grady. 


I thought for a moment Ms Bernard was being interviewed in the actual Skylight development, but no, it was the lavish sales office.  


Skylight is still just a few holes in the ground although the video above went to air in June 2013.


June Bernard is known throughout Asia from Bangkok to KL, Jakarta and Manila, for her involvement in ‘boiler rooms’ -  selling fraudulent shares, specialising in  ‘slopping’ – and working on boiler room left-overs (slops).  


The boiler room reaction is of course: 'If you send money to someone after just reading something on the internet and speaking to someone over the phone - then you're a total wanker' and deserve to lose it.'.



Ocean Tower and democracy


And finally we go to Ocean Tower 1 billed in the Thai national media as the tallest residential building in Thailand and one of the tallest in the world. 


This was due to be completed in 2008. The CEO Bruno Pingel still insists its going ahead and its website is still up and of course bookings have been made by those who believe in Father Christmas. 


Pingel does not like military governments from this item (above)  which is second item down on the news section of its website. Oh dear, Time for an edit.

So there you go for starters. Take a drive through town and have a look at the quiet construction sites.


A couple of simple tips: (1) If you really want to buy - buy where the Thais are buying. That is usually from a well established LOCAL or Bangkok property company. Thais by law will have to have control of your condo anyway 51/49 per cent (2) Buy property which is already built. (3) Do not believe anything the salesman says and study the contract closely. Promises are made NOT to be kept.




In the coming days we will be taking a closer look at one rogue trader.

Fresh from his acquittal of a spurious case brought against him by fake lawyer Drew Noyes, oilman Ally Cooper is now offering a 50,000 Thai baht reward for anyone who tracks down the other famous fake lawyer, namely Brian Goudie, born Goldie, from Falkirk, who posed an an officer and a gentleman.

So here is Ally's poster. 

I guess come cash will also probably needed to persuade the Thai police to do what they are supposed to do when a warrant of arrest is issued.



Actually our not quite resident artist 'The Weapon' for whose photo-shopped pictures Goudie issued multiple writs, until the law caught up with him on other matters, has quite a library now of Goudie mickey-takes.
















The last picture is how Ally and a lot of people would like to see Brian but personally I sort of like the idea of him running around with a young lady from Surin who thinks he's the bees knees.


Certainly in recent pictures he does not look his normal jovial self (above).

His passport is with the Thai court so I am expecting the British Embassy to give him a new passport and for Brian to turn up in Sihanoukville for some new adventures.

AS HUNDREDS WHO PLANNED TO LIVE THE DREAM IN THAILAND FACE RUIN - DEVELOPER GOES FOR TARGET PRACTICE


Imorn has some rough edges reportf buyers
A popular ‘independent’ Pattaya property writer appears to have had a ‘Road to Damascus’ conversion and is having trouble getting on to his keyboard to write another word about the local industry.

Writing and blogging under the name NEWPATTAYA he committed to Facebook in a mood of melancholy.

Having spent years promoting property in Pattaya much of it by unscrupulous businessman he has to come to terms with his 'raison d'etre'.

And it seems he cannot find any.

“The worst thing? It is knowing some good stuff and not feeling in the mood for writing about it. This feeling that things have changed, that things are not the same as they used to be.The question is; Have things really changed or is it just me that has been here too long? Am I the one that has changed?You know, when I go and explore other cities I am still my old self. It is clear that my feelings towards Pattaya have changed.Pattaya used to be the centre of my universe. Now I feel nothing. Nothing at all...Yeah, confession time.....”
This sound a far cry from the blurb below with which he opens his website.



Ignore the cosmetic soul searching and self questioning. Actually this confession lasted only a couple of days. He took it down yesterday. 

Perhaps the conscience of writers down on the eastern seaboard is as momentarily accidental as that of some property dealers.

But of the last story written on this site about property developers in Pattaya he goes on to say:


“Parts of the article might be true, and if so, it means there will be big changes in Pattaya in the near future. 
I am not sure if posting the link would get me in hot water. Not worth it.... 
This might be the story of the year 2016. This could be pretty big if you ask me...”

And in answer to a request to post the article he replies:


‘No, why take that risk? I am not looking for trouble. It is about the local mafia’.



Surely not? NEWPATTAYA'S depression could perhaps have been diagnosed last year when he wrote:

” My predictions regarding the property market in Pattaya finally came true. The bubble really did burst. I never imagined it would come to this, I never imagined it would be this bad. The real estate market in Pattaya is in the middle of a very difficult time. Frankly, writing about it is depressing. For several reasons I won’t be able to tell the full story. But even the part I am allowed to talk about is ugly.”

It begs the queston - who allows him to write. But he then provided a list of over 20 projects which he, perhaps understating, says have caused 'raised eyebrows'.  I can't imagine what makes his toes curl.

NEWPATTAYA and the local newspapers have a lot to answer for - for not talking about that ‘ugly’ part and NOT daring to be different.

They were ALL willing to take the advertising and now may wonder why their credibility is questioned when they do not report what happens to these projects.



Here is for instance what NEWPATTAYA wrote about ‘the best condo deal in Pattaya in 2012 from the company CW Assets, which has been repeatedly exposed on this site.


The Abtalay land being sold from under Imorn's feet.  She had never paid for it.



 Ladies and Gentlemen, I give you AbaTalay Condominium located right here in Pattaya. AbaTalay Condominium may just be the most attractive condominium value offered to buyers in the market. 
Listen carefully: price starts at only 30.000 Baht per square meter.
You have to travel at least 10 years back in time to find similar prices. 
These days it is difficult to find new developments with prices at less than 60.000 baht per square meter. 
This certainly is the best condominium deal in Pattaya in 2012 – it is not bad to be the best considering Pattaya is experiencing a property boom with dozens of developers competing right here and now. 
Investors had better hurry up before this property sells out. 
Once the word gets out it may be too late. Prices from as little as 699.000 Baht sounds too good to be true. 
But it is true and it is also true that there are only 215 units in this development. The first month 15% of the units were sold.

Not surprisingly it wasn't true. Abatalay has never been built. And there are some very angry investors out there.

New Pattaya’s follow up last year was muted and it’s now on his ‘raised eyebrows’ list. He wrote


‘Seems like the project just disappeared”

He could have prefixed that with 'whoopsy'.



NewPattaya – and most of the local newspapers for that matter – must have known that the company CW Assets had a tainted reputation before it even started by its involvement with Richard Ian Silver – ‘The Guv’ – who sold a fictitious condo called ‘Royal View Talay’ before walking off with buyers deposits.

He was the common law husband of Imorn Luekhamharn the principal Thai person in the projects Abatalay, Bang Saray Beach Condo, Abatalay, and Bang Saray Ocean View condo. and CW Bayview.

This company did actually sort of complete Bang Saray Beach Condo (BBC) eventually (read on), but Abatalay and Ocean View which were due for completion three years ago, and CW Bay View remain paper dreams.

In fact as we revealed here – Imorn was selling units in Abatalay when she did not even have the land let alone the bricks.


BANG SARAY BEACH CONDO



But first of all lets look at the one condo that CW Assets did build and then boasted hundreds of happy buyers.

This really is not quite true and there are precedents to this sort of behaviour.

In fact many buyers were not happy. This condo was promoted as a green project according to a write up in the Bangkok Post.


It was promised in March 2013 but delivered incomplete  in December 2014 and not to the specifications promised. It was not in the least bit Green. The promised swimming pool was not completed until the beginning of this year, and was more of a plunge pool than the one illustrated. Parking is available for ten cars for 200 units in area you need a car to get to.

"Its not a place to live in," said one of the buyers


SOLAR ENERGY - 'We'll sell our electricity to the Generating Board'.



“The 220-million-baht Bang Saray Beach condominium will generate its own electricity from solarpanels, said Ms. Luek, managing director of CW Asset Co, the project developer’
 

‘The electricity generated by solar panels will be used to light all internal and external common areas as well as power common-area facilities. Excess electricity produced will be sold to the Electricity Generating Authority of Thailand.
 

"This green system is expected to help a condo juristic person reduce spending on power by 50-70%," Ms. Amorn said.
 

"CW Asset has made it a priority to develop residential projects that have green operations and sustainable practices," she said. "We feel it should be a priority for all types of buildings to strive for the goal of green processes and sustainable eco-friendly methods.”  Bangkok Post



WATER RECYCLING

“Bang Saray Beach Condominium will be an energy efficient building, generating its own electricity from solar panels, recycling water for landscape use and minimize water-consumption with high-tech plumbing fixtures.” Homebuyers News

"The 220 Million Baht development will generate its own electricity from solar panels. Wonderful – they strive to become an environmentally friendly development....We hereby recommend this project - NewPattaya.com

Residents moved in to find no such features. The only energy saving equipment was flourescent lightbulbs.

The metered electricity rate was in fact fixed above normal by the developers who have refused to attend residents meetings to discuss the issue.

There was no water recycling.  The developers did not even put bricks in the cisterns as a water saving gesture, joked one of the new residents. The plumbing fixtures were to pardon the pun - bog standard. When people complained the company finally replied:


“CW Assets does not control the public news. News stories are not company advertising and not part of the company’s agreement to sell.”

They pointed to the company’s disclaimer stating prices, features, conditions etc., can be changed without notice.

In other words ‘you can’t believe the lies we tell newspapers,’ because if anyone now believes the property journalists down on Thailand’s eastern seaboard, or Bangkok for that matter, then they really are living the dream.

Needless to say a series of salesman have quit the company, one specifically complaining to Richard Richie, Ian Silver, Richard Ian Silver, or as one wrote ‘whatever you call yourself,' of unethical business practices.

The salesman demanded payment of monies due (8 per cent commission on every sale) stating that he had saved the company from damaging and potentially successful legal action against it.

Buyers however are cynical of the view that he could be a Pattaya property man with a conscience.

As CW Assets are in the cheap end of the market they attract customers who do not have much money to spare – not least to take expensive legal action. The costs are likely to exceed the price they paid for the condos in the first place and CW are well aware of this as shown below.


BANG SARAY OCEAN VIEW


Work on Ocean view stopped after two weeks

Currently over 200 customers are complaining  about CW Assets, according to a buyers' representative.

Not only has CW Assets failed to start work on Abatalay, and is unlikely to, it has also failed after ground clearing to start its third project Ocean View condo which was due for completion a year ago.




One of many customers who complained received the following reply:


“So sorry for the delay. We are working as fast as we can, given the political and financial state of Thailand.
We are continuing with construction. We have a government approved construction permit. 
Please consult your purchase contract for the completion date you agreed to accept. 
There has been no legal breach of the purchase contract and no grounds for any legal action. 
A reminder that per your signed purchase contract you have agreed to Arbitration, not court action to clear any contract disagreements.
The Thai court will dismiss any court case submitted and you will lose hundreds of thousands of baht in legal and court fees. Thai lawyers may or may not tell you this, their priority seem to be getting paid. 
One final note. Your written email statements constitute criminal libel in Thailand punishable by imprisonment and payment of large financial damages. Court actions last for years requiring your constant personal appearance 
However we will not proceed with a criminal complaint against you at this time, but maybe later.
Update: We will be completing Bang Saray Ocean view condo as soon as possible per the signed purchase contract.”
 Having read the above, clearly not written by a Thai, the client then looked up the formal agreement he had been sent to view before signing.



 And then he compared it with the agreement which he actually signed.




Yes the completion date has been removed entirely and now he was being threatened with libel.

His demands for the proper original contract of course fell on stony ground.




In CW Assets latest project CW Bay View Imorn and Richard Richie (Silver) are offering affordable luxury in a natural setting. This project has been promoted since 2013 but even many Pattaya's estate agents have cottoned on and realised that it could be damaging them to promote sales.

COMMENT:


WE SUPPORT THE MILITARY GOVERNMENT.


Well, sometimes, er, not that often actually. But if they can do something about Pattaya, and, well, don't screw it up.



Actually this whole story is something of a comment. I have not disguised my views. This is not a ‘ he said, she said’ report. CW Assets have made it clear in statements to buyers that they will not answer media enquiries on their complaints. And there you have it the scandal of CW Assets has been going on for years – see the links below.

The man behind it Richard Ian Silver, is quite clearly still in Thailand and checks show he is known to others in the property market. According to immigration though there is no record of him under that name.

The company refuses to answer buyers’ questions….and nobody, not police, not immigration, not city hall, is doing or has done a thing about it…because quite frankly they do not care.



Currently the Mayor of Pattaya, Itthipol Khunpleum, is reported to be under house arrest. I have no personal knowledge of this, but his picture is not currently in the local Pattaya English language press and instead events are being attended by his deputy Ronnakit. Here above is a video of the Mayor dancing along to the 'Pattaya Wonderland' song because it cracks me up every time I see it.

Of course a news event of such magnitude would struggle to find a place in the local media as it stands.
The military will move in. I am not supporter of the military. I am however a supporter of any attacks on endemic corruption.

The problem of course is that the military while having some good intentions, almost certainly never seem to show  know how to go about the problem. It also seems to have difficulty in determining who the enemy is. In the big picture the military might merely replace problems with larger ones.


But its time foreign criminals, and here I am referring to long standing networks already set up, and avaricious developers, were not treated like royalty, and foreigners who want to invest or retire are not routinely fed to the sharks,

FUGITIVE? WHY DID THE MAN BEHIND CW ASSETS RUN FROM THE UNITED STATES

ARREST WARRANTS ISSUED FOR RICHARD IAN SILVER

A man with an identical name to Richard Ian Silver- the foreigner behind CW Assets property group on Thailand’s eastern seaboard - has had warrants of arrest issued against him in the United States in connection with property fraud.


While operating a company called the ‘American Home Buyers Association’, together with John Robert Young, a Richard Ian Silver were accused of false advertising and collecting advance fees for home buying, and also credit repair services, that were not delivered.

This dates back to February 1998 when a warrant of arrest was issued in West Los Angeles, California, according to Deputy City Atty. P. Greg Parham.  Young was arrested in Pasadena, but Silver, who then had an address in Venice, became a fugitive.

At the same time Silver and Young were also wanted in Arizona on similar charges. 

Ian Silver was the man behind publication called ‘Pattaya Info’ and the westerner behind the CW Assets property group, which took multi millions of baht for projects such as Abatalay Condominium, Bang Saray Ocean View Condominium, and Bay View Condo.



But prior to that he was accused of running away with millions of baht from buyers on a project called Royal View Talay which he put on the market in September 2007.



To this day many people are still seeking their cash back.



However despite a claim that Thai police and the US Embassy were following the case - nothing happened.

In Arizona more detail is in the public domain of the Richard Ian Silver involved in the home buyers fraud.

“On March 8 Attorney General Janet Napolitano announced the Arizona State Grand Jury has indicted Kevin M. Short and Richard Ian Silver alleging that they defrauded low-income individuals. 
The company advertised itself as an alternative mortgage provider that could help low-income wage earners or individuals with a bad credit profile get a home loan.”  
“The homebuyer would fill out an application, pay application fees (up to a month's salary) and were told to look for a home they wanted. Once the house was located, Community homebuyers promised either to obtain financing for the buyers or purchase the home and sell it to the individual. 
Many individuals paid a $100 application fee and others paid an additional fee ranging from $500 to $4,000 dollars. 
None of the victims ever received a house or a refund. In July 1997, Short opened Nationwide Home buyers where he allegedly continued the same practices until April 1998. 
At least seven individuals fell victim to his scam where, again, no homes or refunds ever materialized.”
If convicted in the US, each faces up to 12-1/2 years in prison for the fraud charges and 8-3/4 years for theft, added the state’s Attorney General. (Sources LA Times and Savingtownsquare.com).

Imorn
After we revealed on this site that an ‘Ian Silver’ was receiving money in his PayPal account from condo buyers  in CW Assets his partner Imorn Luekhamharn denied the PayPal records and but later announced that Richard Richie known to us as Richard Ian Silver had been dismissed from the company.

That of course never happened, according to buyers. 

His name was however removed from the company records of CW Assets when he owned slightly half the company.

Richard or Richie is still the man who deals with customers and his sales team, albeit often from the end of a phone or email.  




He also keeps all the passwords of his staff's email accounts and speaks sends message and emails to customers posing as members of his sales team.

Imorn at the time claimed to have a BA in Marketing and was studying a Masters Degree in Education, or rather the person writing in her name did. Her English is limited and she is referred to buyers as a country girl or former employee in the entertainment industry a 'little rough around the edges'.

Articles written by her as a property guru and published in property magazines are local newspapers are believed to have been written as Silver, as even her spoken English is quite basic.

Richard Ian Silver is known about town in Pattaya and can be occasionally seen at the ‘Baccarat’ bottomless bar in Pattaya’s Walking Street, which on last checking was 50 per cent owned by Bangkok boiler room boys.


He is known to have had a relationship with Richard Haughton, who pulled off the Emerald Palace scam, selling units in Emerald Palace condo in Pattaya and then hawking all the deeds to the Kasikorn Bank for a 70 million baht bank loan. 

But the relationship did not develop into any business deals.  At the time Silver described himself an American professor of economics.

At this stage the Richard Ian Silver scamming on home in Pattaya is not conclusively linked with the alleged scammer from California, but the date of his disappearance from the US co-incides with the arrival of a Richard Ian Silver in Pattaya, and the nature of the scams are very similar,

ROUGH JUSTICE: FOREIGN WOMAN JAILED FOR REVEALING HER RAPE IN THAILAND

AND THEN WHEN HER CLAIM WAS VINDICATED THAI AUTHORITIES BANGED HER UP AGAIN AS AN UNDESIRABLE

A French woman was jailed for a year in Thailand after going public when she was raped by her Thai boyfriend. 


She was jailed in the northern capital of Chiang Mai under Thailand’s Computer Crime Act Libel laws pending trial but charges were dropped after friends provided evidence she had on her mobile phone.

But Immigration authorities, operating under skewed revised laws introduced by the military, banged her up again, this time in the notorious Immigration Jail in Suan Phlu, Bangkok, because she had not renewed her visa while in jail.

Friends of the woman, known as Marjorie, have so far raised US$10,000 out of US$30,000 needed to fight against her deportation and to fly her mother over from France to be her companion during the ordeal.

"We are a group of expatriates living in Thailand.Last year, our friend Marjorie -- a French expat -- filed charges against her then-boyfriend after being violently raped by him.

"Unfortunately, due to Thailand's defamation laws, Marjorie was arrested after speaking out about her ordeal online. After spending a year in jail, Marjorie was finally released last week. Her legal troubles, however, did not stop there. Because she had been incarcerated for months, she had been unable to renew his visa and was now considered by the authorities as having overstayed. 
Upon release from jail, she was then immediately sent to the Immigration Detention Center in Bangkok where she still is at this time. 
Since, under the new immigration rules, agreeing to be deported would mean a three-year ban from entering Thailand, Marjorie decided to fight her case in court. Having lived here for over five years, she has more ties -- financial, relationships -- with Thailand than she does with France. 
As her friends, our goal is to help her fight this legal battle and bring her moral support. At this moment, Marjorie is sharing a cell with over 60 other inmates. The cell is stifling hot, with only a few fans there to fight the tropical heat and humidity. She is only allowed 2 bowls of rice per day and has to remain in the cell at all times. Only yesterday, she witnessed the death of another inmate in that same cell. Our goal, as Marjorie's closest friends, is to bring her moral and legal support. Unfortunately, those do cost money, especially in Thailand, where "hidden legal fees" are often required. While we cannot explicitly state the nature of those fees, anyone familiar with the Thai judicial system knows what those fees are. These are the things we need at this point: Funds to hire competent Thai lawyers to fight the immigration case in court. 
Funds to bring Marjorie's only living family member -- her mother -- to Thailand to provide her with emotional support.Funds for "fees" required by the legal system (see above) All in all, all of those items amount to over $30,000.We already came up with $10,000 out of our own pocket, but we need your help and support to reach our goal."

COMMENT:

There are facts missing from this story and questions I have. But three major issues are already known. 

(1) Thailand's Computer crime laws are the first resort of crooks. They know if they lay charges the defendant will have to pay bail to stay out of prison and could face years in the courts - and if they are acquitted they do not even get costs. They then have to take expensive court action to get their money back. The chances are by this stage most will have no money left.

(2) Under Thailand's revised immigration laws anyone who overstays a visa is subject to deportation and a three year ban. The Immigration authorities no longer ask why? People in jail previously automatically had their visa carried over - and if they were not guilty they could renew it.

(3) Not many foreign woman report rape. Why? They would subject themselves in Thailand to an ordeal of mammoth intensity. Despite repeated seminars held by foreign governments instructing Thai police in how to deal with sex crimes, very little of this has rubbed off. Male officers are still used to interrogate female victims, and there even appear to be queues of them. Thai police as a rule believe that foreign women are up for it - and a case like this where the rapist is a boyfriend would not see the light of day - and hasn't.

BUT DEPARTMENT OF SPECIAL INVESTIGATIONS HANDS FILE TO TAX MAN AFTER DIPLOMATIC RUMBLINGS

Norbert Verweyen the rogue property developer on Koh Samui, who appears to have spent an inordinate amount of time terrorising his buyers with Computer Crime Act cases and others, appears to be beating a tactical retreat.

The man, mainly known for companies with the name ‘Coconut’ in them, has started pulling down signage on the island for his company called #OK Properties.

Buyers of his properties were amused during the enquiry into the murders of Hannah Witheridge and David Miller to learn from Thailand’s police chief that there was ‘no mafia’ in the Samui Archipelago.

(The Regional Police Chief General Panya Mamen was removed after declaring it was the mafia wot did it.)

They were amused mainly because there was no way in a civilized world that #Norbert Verweyen, who was also accused of commissioning physical attacks, could ever escaped such a litany of harassment if the local mafia were not involved.

And for mafia on Koh Samui – read influential people.


The British Embassy has of course expressed its concern with other Embassies in Thailand (above). 

But this has been going on for years and of course Verweyen proudly displays a picture of himself (top) with the ultimate Godfather of the south. Suthep Thaugsuban, former Democrat Party deputy leader, and Secretary General of People's Democratic Reform Committee (PDRC) or "People's Committee for Absolute Democracy With the King As Head of State". Thus perhaps he feels that he and is property empire are bullet proof.


On this site we reported, perhaps in the light of Verweyen’s new notoriety, that the former optician, had resorted to hiding behind a new company OK Properties.


This was his new internet image and the one he presented overseas as he offered high class residences on the island for sale or rent.

OK PROPERTIES FROM STRENGTH  TO...

OK Properties was never registered as a company in Thailand, so if anybody paid a cheque to them, they would have little recourse to a refund.

But now the hoardings have come down and a quick check with the Department of Business Administration shows that he owns nothing at all.

TO STRENGTH?

The website for OK Properties is down but search OK Properties and further down you will see another site announcing ‘Everything is going to be ok with OK Properties’.

Here at Samuiholiday.com (billed as Samui Holiday Magazine) you will read this, which must be having buyers on his Santi Thani estate in stitches.

“Norbert has a good team of people working with him, most of whom speak his native German, as well as other languages, which helps in dealing with international customers. 
OK Properties has gone from strength to strength over the years, with the majority of sales coming from good old fashioned ‘word of mouth’. 
The company’s tag line is ‘Quality doesn’t lie’, and even the properties built 20 years ago are still in good condition and well maintained. Buyers aren’t deserted after the sale and continue to receive support from the company - it’s a perfect partnership. 
Norbert has become friends with a lot of his buyers. “First a customer, then a friend,” he says.

Verweyen has been involved in over 100 court cases with his buyers/friends that included, as well as criminal defamation, bringing charges against buyers who set up estate committees to protect themselves from him, for working without a permit – which involved 80-year-olds having to attend court to defend themselves.

People around him have had unfortunate accidents including his late wife.


And his former head of sales Briton Gary Pearmain was also gunned down - but survived.

I cannot find any record of convictions for either of these offences.

How Samui court could take Verweyen’s cases seriously is of course beyond comprehension: Well perhaps not so much now in the light of the Koh Tao cases and that of Jack Hansen-Birtel.

His future ‘friends’ won’t find him at OK Properties, but they might find him at Monsoon Villas or at JFK Villa which is promoting Verweyen products.

So why all this smoke and mirrors?

It may have something to do with a latest complaint, through diplomatic channels and all very secret, to Thailand’s DSI – who took one look at Norbert and came up with ‘A-ha phaasi”

To you and me that’s TAX.

Of course complaints to the DSI and re-assurances that something will happen do not mean that anyone is really listening and something will happen.

They could simply be buck passing to the tax department.

If he has not paid any tax then Norbert I guess must have had a long local arrangement for years.

From this chart it does not look like the companies he now no longer owns have paid any at all. Pharanya Khana Rat is is current wife.

The worry for Norbert is of course that the current military government have vowed to clear up mafias, and undesirable foreigners, and the opinion in Bangkok is that they are quite successful at it.

Not only that, they say they intend to go after ALL mafia, the mafias supporting the ousted PMs Thaksin and Yingluck Shinawatra and those in the south of Thailand supporting the democrats.

Whether the military will replace the mafias with their own, a view held by us cynics, is neither here nor there…Heads will roll, and those heads could be those who have supported Verweyen for so many years.

Debbie Abrahams, Labour MP for Oldham East and Saddleworth, in the U.K. had written many times to the Foreign and Commonwealth Office about the problems with Verweyen on Koh Samui after complaints from a constituent.

In the official response the FCO stated that it couldn’t get involved with overseas legal proceedings.


This led to Ms. Abrahams commenting officially.

“This has been an incredibly frustrating and drawn out process for (my constituent). I know she’s deeply disappointed with the investigation process but I will continue to support (my constituent) in any way I can."

The other stuff is of course all unofficial. And so it should be.

While the military government says it will crack down on mafia, it rarely has much diplomatic dialogue with Embassies here, and terrorized foreign homebuyers on Samui may not be near the top of their list.

Verweyen could be as safe as houses.

After all he did arrive on the island when it was tranquil, unspoilt and one could get a beach bungalow for US$3.00 a night.

This story is centred around  allegations of blackmail, fraud, fear  loathing and corruption as the highly successful ThaiVisa.com revamps itself from its new base in Pattaya - But  with a British ‘estuary man’ as nominal head, the Thaivisa family appears to be tearing itself apart.

Well it appears only one man was rewarded, Swede Eric George Anderssen, a man who has completely erased his former life as Lars Jansson a man who made a complete mockery of Thailand's Immigration department, when after being deported and blacklisted, he returned under another name to offer immigration advice to foreigners.

And in his very own words this is a story of blackmail corruption, bonking, and blocking. It’s of Moderators and Administrators arrested for murder and child sexual abuse – but most of all it’s a story of greed.

Currently two Administrators, German, Matthias Schoenfeld (Webfact) and Briton Jonathan Fairfield (Jonathan Fairfield) who has little to his name apart from being a Stockport County FC supporter furiously work from their apartments in Bangkok and Hua Hin trawling the internet to copy and paste news stories to put on the site, to drive up the readers’ comments, to drive up the stats.

Fairfield was employed on ThaiVisaProperty - an ill ventured attempt into Thailand's property market. Mods describe hims as their new dictator.

Neither have work permits to do this, nor have the 'new writers' and the site now struggles to produce its own news,

Schoenfeld, a pensioner, is reported to be doing a 100 hour week to stay on board. And it looks like it’s going to end in tears. Already moderators are jumping ship.

And who are the new media moguls? They are on the face of it from Pattaya’s dodgy property and former Copenhagen gangster Niels Colov’s Pattaya People media group.

But that looks cosmetic.

HOW A BRILLIANT BUSINESS SUCCUMBED TO GREED


The Thai-Visa.com media empire of Swede Eric ‘George’ Anderssen had had a tough year in 2015 and George knew he had to get out with his cash.

From emails leaked to this site it is easy to follow his bids to enrich himself. He had started spin-off project to pull in more cash but all were failing because of his own excessive demands and while he was using the internet - the speed of development on the internet was fast overtaking his own plans.

TRAVEL: He had tried to set up business with Australian Danny Pattison who ran a travel business in Pattaya. And when that he failed he attempted the same with our own Drew Noyes ( currently in the USA having fled an extortion conviction) and that failed too.


PROPERTY: He set up Thai Visa Property to cash in on the lucrative and profitable market in selling property in Thailand to foreigners.

INSURANCE:He set up an insurance deal with AA Insurance in Thailand for which he would get commission off every policy sold.

LEGAL SERVICES:  He set up partnerships with lawyers and lawyers’ representatives, Siam Firm Inter-Law and Interactive Associates, who had helped mastermind the frameworks’ for Bangkok’s avaricious boiler room boys Glen Bullard (now deceased) and Paul Hayward. 

Siam Firm Inter-Law had already been removed from the British Embassy list following complaints.

Somsak Chokapa of Siam-Firm-Inter-Laws was also offered his advice column.

The column seems dormant.

But funnily today at the top of the list of unanswered questions on the ThaiVisa Ask the Lawyer site at the moment is: 


"I was defamed and slandered and libled (sic) on line. I have all the evidence. But the person has left Thailand. Do I persue them in thier home country of here where the offence took place?" -Joeriki123 
Meanwhile at Thaivisa.com under Law in Thailand and above 'Ask the Lawyer' you will see the heading Marriage and Divorce.  

This section is of course sponsored by One Stop Legal Services and here you will see Drew Noyes (currently in exile in the US with no wives and just half his children after fleeing an extortion charge) waxing lyrically on how to get divorced in Thailand and your money and property back.
ThaiVisa.com which was set up, other founder members say, with the intention of providing a platform and problem solving base for the foreign community in Thailand had fast become a platform for fleecing its own community – and readers were noticing.

Most of the money making projects had run into problems. He was demanding too much in commissions. It was not a good deal to book a holiday, rent a car, or take out insurance, when the bigger boys were producing websites where you could actually find the best deal.


And records show that Anderssen was falling out with all his partner businesses. 




The AA Insurance deal was cancelled by George in a pique.



Travel@ThaiVisa crashed and Rodney Pattinson, who went on to earn money as a comedian hypnotist before returning to Australia, was dropped in favour of Drew Noyes, who promised the world by setting up two travel stalls staffed by Filipinas on the second floor of Tops in Pattaya. Needless to say that went nowhere either.

(ThaiVisa did however go into partnership with Noyes on a ‘watching paint dry’ legal seminar in Pattaya set up by Noyes with the Chonburi judges.)

Rodney Pattinson, who later got on better at Inspire with the new boss Dan Cheeseman said:


"He wanted us to spend $1000's on a booking engine which ultimately he would have owned. He took THB250 per booking but the total mark-up was THB300 people from Thai Visa were tire kickers anyway. We did much better through AUSCHAM we had decent Corporate Clients"



And Property@Thaivisa was having serious problems – so serious in fact that Anderssen’s partner in this project Graham Beecham had decided to sue for criminal fraud.


In short it was agreed that they would share the company 50/50 and Beecham who sold Anderssen his home in Orchid Palms, Hua Hin, worked his ‘butt off’ setting up the business.


Two ThaiVisa Property shops were opened also doubling as bar cafes and then Beecham checked the company structure. He had been allocated just 1 per cent. He hit the roof.



ThaiVisa also now started promoting properties of fraudster Alan Macdonald a well-known rogue in the property industry in Hua Hin who has over 50 cases going through the courts.

Even estate agents in Hua Hin had blocked Mcdonald in their shops.

Many people had lost their life savings on 'properties' from Mcdonald, also a bar room brawler, - but Thaivisa did not appear to care.


Beecham raised criminal charges against Anderssen and Anderssen was cornered. The matter was later settled out of court – but both Visa Property shops have now shut.


StickmanBangkok reported that Anderssen was probably scared to go to court for fear of being discovered that he was in fact Lars Jannson – a Swede not definitely not wanted in Thailand.


True or not, it was never put to the test. What is known is that doors were closing for George, and his promises to float the company and make money for all those who had helped make ThaiVisa successful were not going to happen.


A bitter fight about his past had torn ThaiVisa apart and there had been threats to expose him. This resulted in a vicious email exchange and the closure of the Royal Thai Consulate in Brisbane.

‘George Anderssen’ had pulled off the coup of the century when, after being deported as an undesirable Herr Lars Jansson by the Royal Thai Immigration Police, he returned two years later under his new name to start an 'Immigration' advice website

His crime was not the worst in the world. 

Just like Sean Tinsley, the Pattaya based British ‘Immigration Advisor’ currently appealing a six year jail sentence for an attack on teacher Adam Pickles, George as Lars Jansson had found a friendly consular official, who was happy to hand out long term visas for a price.

Tinsley had a man in the Thai consulate in Cardiff. Wales. George had a man at the Thai Consulate in Annerley Road, Brisbane, QLD, and this was William Dunn.

As a result packages of passports made their way from Express Service Sabai Co., Ltd,  to Australia via Malaysia, and came back. I am told, with entry stamps into Thailand as well.

Stickman, who also wrote about this said that the passports were suspicious because (for non-Australian citizens I presume) there were no in and out of Australia stamps.



In any case  there appears to have been no immediate knock-back to Australia and an investigation was seemingly only carried out in Thailand. 

Lars Jansson (George)  was fined 40,000 Thai baht and deported back to Scandinavia.

But he was back like a Phoenix two years later and William Dunn joined him in founding the new Thaivisa – which was to become and all-encompassing and successful forum with a massive readership.




William Dunn, as Dr.Patpong became an administrator and a moderator and he became something of a star who gave advice on visa issues elegantly.


The rise of Thaivisa.com was a tremendous achievement due not only to George but those around him, even if later it appeared that the behaviour some of them was questionable.

According to TV sources George spend an inordinate amount of time deleting all references to Lars Jannson that he could find, but he did not delete them all.

He was paranoiac about people ‘stealing his money’ and there were frequent disagreements with those working with him  – often about his broken promises.



George could hide his own name - but his wife was still registsred under her married name Jansson for those lucrative ad incomes in Hong Kong/

At the same time Thaivisa’s IT expert David Arthur was deported to Australian on child sexual abuse charges, and a few other moderators also took a dive, most recently Stein Dokset, a super-moderator, who was jailed last year for the murder of his Thai wife in Phuket and hiding her body.

But a final row between George and Dr. Patpong – William Dunn ended in blackmail threat.

Dunn was driven to so much fury that early in 2010 from the Thai Consulate in Brisbane he made an open threat to Anderssen to have him deported again.

What appears to have stirred him to rage is Anderssen’ continual failure to look after him financially, actually blocking him from the site and falsely promising the mods they would reap huge rewards when ThaiVisa went public.

“Your promises, as with all your promises are all shit. It is sad that you will again be deported persona non grata….You are a low life Lars. Your mods actually believe that public launch shit”.




He asked whether George would make 'that speech' from the IDP (Immigration Detention Prison) or the plane back to 'Scando' before take-off.

George wrote back threatening to expose Dunn as 'Binny the Bonker' and he copied the email to Dunn’s Thai wife Mai, also working with him at the consulate.

George had announced that he was preparing the definitive Thaivisa.com story. 

It would include sections on corruption, his deportation and confinement in the Immigration Detention Centre and under the Section Border Runs would include ‘My Honorary Consul friend in Australia with a photo gallery from his home and office.’

The die was cast…..


Sources within ThaiVisa say this was followed through. George threatened to report the errant consul to the Australian tax authorities, said the source.

But it was not until last year that the consulate in Brisbane was closed down and a Dr. Patpong a great friend to many Australians in Thailand became a distant memory.






When his name disappeared from ThaiVisa.com a thread was started – What happened to Dr. Patpong? It is clear from the comments that he was held in high regard.




But nobody was saying why – least of all George.
SBK, an administrator, super-moderator, and shareholder, who had started off on ThaiVisa.com while a manager at the Blue Lotus resort on Koh Phangan, offered a reply.







SBK who is better known in Chiang Mai as American Democrat supporter Shana Kongmum, the managing editor of the Chiang Mai Mail,  announced that he had resigned due to ill health.




George may have fibbed to her of course - on ThaiVisa it seems the biggest fibbers can be not the punters but those that run the show.

But if SBK was fibbing - it was nothing in comparison to the massive deceits that the administrators carried out over the years.

Spare a thought today for poor old Matthias Schoenfeld. This sprightly pensioner who goes under the name Webfact does not have the 800,000 baht deposit to show for his retirement visa every year so his employer Thai Visa takes responsibility for that for him.



But for that – and a reported 65,000 Thai baht a month – seems to work all hours god gave him flooding the site with ‘news’ for voracious readers to have a frenzy on.

On one day last week he had made 128 posts from 5 am to 6pm. That is with no break for lunch – one every six minutes. Now that’s’ hard graft! He can’t have another life.

Well that is one legitimate way of getting readers – well semi legit. Its news aggregation and ThaiVisa is taking hits from other people’s stories.

Though it does warn of other people copying them and boasts a team of ‘ThaiVisa Reporters’.





But what of his timekeeper Jonathan Fairfield, Operations Manager at ThaiVisa, according to Linkedin, and according to ThaiVisa.
“A real news junkie who loves to edit and write. He has previously written for one the UK’s leading watch and horology websites.”

That’s definitely something I’d keep in my waistcoat pocket.
Jonathan is a completely different kettle of fish – and no surprises here as to why this Stockport County Football Club Supporter has found Thailand exciting.

Jonathan is bashing away on his computer almost as much as Matthias. His job with Chief Mod gay Scott is to drive the mods to keep the posts coming.

Jonathan is ThaiVisa’s principal faker of posts and ‘bumper upper’ of threads and its time to call time on this writer on horology.


His total contempt for the readership is obvious, but I have to say at times that's almost understandable, but then I am not serving them.

ThaiVisa seems to be full of foreigners who have absolutely nothing to do all day. And a finer collection of racists and bigots would be harder to find.

But equally I suspect many are foreigners 'living the dream' and sometimes perhaps 'nightmare' in the wilds of north east Thailand who have little to do but meet their mates in the nearest pub 40 miles away, or plug in for some conversation on their computers.

So Jonathan makes up posts, sits back and watches, and occasionally comments on his own ridiculous stories. Its a wheeze.


'On Sunday evening I killed a soi dog'

Take this one for instance from DrRobert77. Here is Jonathan posing as a man who has become so furious with a dog in his Soi that he runs over it with his car.

He is apparently stricken with regret and is now being blackmailed by a neighbor who demands 20,000 baht from him. Poor Dr. Robert. What should he do?



This topic, which should have been answered with the statement ‘Get a life’ rumbles on for over 17 pages mostly contemptuous of his fictitious Thai neighbours with occasionally Jonathan answering as Dr. Robert or chipping in as PinkPanther99 from the same isp number.



Yes and you’ve guessed it Dr.Robert and Pink Panther are the same and all over the place on Thaivisa.

Anyway you’ve got to feel sorry for Jonathan. In this post he says his Thai Chinese hi-so wife rarely has time for sex nowadays. But never mind. He’s got ThaiVisa and the local 7/11!






Nah. He’s making it up. A Stockport County supporter who writes about horology with a wealthy hi-so Thai-Chinese wife. His only saving grace for his wife would be that he might be good between the sheets. He’d have had a proper work visa a long time ago, not that dodgy one for selling ThaiVisa Property.

Moderating the Mods

Readers will of course by now have come to the conclusion that my sources on ThaiVisa are quite good. Not all those working for it are greedy aspiring media wannabes or time-share salesmen. I am of course aware who they all are with all their telephone numbers, email, addresses and emails. And can of course I can see what they are saying privately to each other.  Actually not surprisingly its quite boring.

No I do not have it in for ThaiVisa nor even the faintest obsession. But I am a journalist. I do not hide behind another name. I don't hoax. I correct if I am wrong (You need to explain yourself Badbanker)  The media is not a game.

At this stage it would be churlish to name all these people (Moderator01) . And while there may be a rush to change names etc I guess I will find out about that too.

That's not the point. Now that ThaiVisa has been 'acquired by' the Choice Group and Inspire TV the new bosses should be making it clear that faking comes to an end, false post boosting comes to an end, and promoting shady organisations comes to an end., or simply admit 'We're ThaiVisa. We're oiks.  We think you're jerks and we want your cash and we don't care how we get it.'

In the meantime if you think a Thai Visa moderator has crossed the line - let me know.

PROPERTY FRAUDSTER RICHARD SILVER CAUGHT ON CAMERA

'PROPERTY AGENTS HAVE RUINED MY COMPANY' -  SAYS BOSS OF IMAGINARY HOLIDAY CONDOS



This is the man known as ‘Richie’ and Richard Ian Silver who is conning millions of baht out of property buyers on Thailand’s eastern seaboard.

He was recently caught dining out in 'Sizzler' restaurant in Pattaya with his latest female companion.


An American citizen, he bears the same name as American Richard Ian Silver from Venice Beach, California, wanted for property fraud in two US states and he has pulled off property fraud in Jomtien and Bang Saray, south of Pattaya.

Hundreds of Brits, Europeans, Australians , Chinese and Russians have lost millions of baht to CW Assets which he runs with his former girlfriend Imorn Leukhamharn.

Under the name Ian Silver previously took over a hundred others to the cleaners with another condo project Royal View Talay in Jomtien years ago.



Imorn and Silver have floated many projects on ‘artists’ impressions’. 

They have only managed to deliver one, Bang Saray Beach condo, but that came in the style of a block of Thai workers’ rooms, not a sun powered, water-recycling ultra-green condo with large swimming pool as promised.

They have taken money on several others Bang Saray Ocean View, Bang Saray Bay View and Abatalay. Not one brick has been laid in any of them.


Due diligence? They wrote it themselves

They do not even own the land or have any rights on the land earmarked for Abatalay sold under the name AT Jomtien Co.Ltd.,…because they never paid.




And even though last October a Thai court gave them the option to do so – they have not and have passed the deadline to purchase. 


Thus they have deliberately defrauded the buyers while threatening them under Thailand’s Computer Crime Act laws if they go public with their complaints.

Now the land is up for sale again by its rightful owner and a new sign is up (above).

But it still gets pulled down (right)  by I wonder who.

Pattaya is of course one of the world’s fraudster paradises. 

Local police will not investigate property fraud. The local Consumer Affairs Departments are stacked ceiling high with complaints of property fraud. 

They say they have too many. But there is little evidence to say they have acted on any or will they unless their palms are crossed.
As a result fraudsters merely move on from one scam to the next.


The local media will not help either. They are part of the problem having heavily promoted these projects.

And of course if people give cash to some ‘ property developers’ in Pattaya they are merely giving away the cash they will need to fight for their money back in courts.

According to the source he was angry that local agents were no longer promoting his property. And THEY had ruined his business.

I have lost count of the amount of times I have warned about the shady dealing of these two people. Simple checks on them show they are not who they claim to be. But this case is symptomatic of the state of affairs on Thailand's eastern seaboard.  This really is mafia central and providing you are paying into the coffers of the people who are running the place your life of crime is assured. The only way to neutralise people like Silver is I am afraid outside the law or bringing them both up on criminal charges and ensuring he does not flee. Personally I am surprised he has not gone already. The legal way takes complex planning, is not reliable, and can be debilitating which is why I am afraid many Thais will act outside of the law.
