SEAN TINSLEY WALKS AGAIN

Friends and relatives of Adam Pickles the Head of English at an international school outside Pattaya on Thailand’s eastern seaboard have reacted with fury to the release of his convicted assailant on bail to appeal to Thailand’s Supreme Court.

Though it was inevitable that Sean Tinsley, who operated a Visa agency in the resort, would get bail for the appropriate cash the reaction not surprisingly has been of anger.  Adam Pickles,41, a teacher at the International School of the Regents has been in a coma since the attack in 2012.

Tinsley, 43, from Wolverhampton, who was shown on CCTV apparently boasting about the attack was acquitted at his trial. The family changed their lawyers from a duff one  on the British Embassy list, and appealed.

At the time his mother Adele Pickles from Thorner  near Leeds said: ‘Justice has been done’.

Now the family want their lawyer to counter the appeal with a submission to re-instate a charge of attempted murder.   Tinsley is alleged to have attacked Adam, who was married with a young son, with a wheel brace after Pickles is said to have brushed his car scratching it.

It is common for foreigners to flee Thailand during the criminal process have paid large bail bonds and it is a common belief that the courts prefer the cash regardless.

“I don't have any word to act on this, except what an absolute joke. Do they not see that he failed to turn up to his court date?! Where will he go this time ? Do we have any news about the conviction maybe being changed to attempted murder ? I'm appalled.”

Yes, This Is Thailand. Corruption and money rule in the parts of society that should be leading the nation to a better and fairer future. Constant news like this makes me feel ashamed of living here. Corrupt Police and Army staff being moved to 'inactive posts' whilst still being paid after being exposed for blatant wrong-doing..and politicians working hand in hand with them. All that pain, hard work and money invested in the face of simple justice amounts to fuck all. Best thoughts and love to his family, friends and supporters.

It could take 10 years.for a supreme court judgement. By that time most people have moved on run out of cash or died. Its the Thai way......Thai and justice is an oxymoron..

Investor Alert – Fleeing The High Court Or Looking For Marks In ‘Bongo Bongo’ Land?

A former director of the small British financial company TBO, 65 per cent owned by former Ukip member of the European Parliament Godfrey Bloom – once described as one of ‘Britain’s national embarrassment’  - has been operating in Thailand as an unregistered independent financial advisor.

Christopher Tressider, appears to have the left the UK since the High Court awarded an elderly couple some £2 million in damages after the company which provided ‘negligent advice’ gambled their money away on high risk funds which crashed.

The couple,  had  yet to receive a penny, the Independent newspaper reported last month.

'Since the High Court ruling, TBO has ignored all communication from the Mohun-Smith’s solicitor Jonathan Mortimer, from Raworths in Harrogate, including requests to provide details of TBO’s insurance policy.  
Mr. Mortimer has now written to all three TBO directors – Mr. Scott Robinson, David McLaughlin, a former Ukip employee in Mr. Bloom’s office, and Christopher Tresidder – as he pursues them individually for the £2m compensation advising them to take independent legal advice in respect of personal liability.'


 Andy Mohun-Smith said:
 “I relied upon [TBO] to put in place investments for us that would provide a reliable and comfortable standard of living for the rest of our lives. However, to my complete horror it has become clear that nearly all our money was placed in unregulated collective investment schemes which have been suspended with an almost complete loss of capital.”

Christopher Tressider has been linked to Norman Edwin Steele who was recently highlighted on this website.

Let’s hope he does not take after Godfrey Bloom, who in 2013 was the overwhelming choice for the Plain English Campaign’s ‘Foot in the Mouth Award’.

Godfrey Bloom referred to ‘Bongo Bongo land’ when making a speech about Britain’s foreign aid, called women delegates ‘sluts’ at a party conference, and stood up at a European Parliament session, and attacked a German MP with a Nazi salute and shouting ‘Ein Reich, Ein Volk, Ein Fuhrer’.




Amazingly while a member of the European Parliament's Committee on Women's Rights and Gender Equality he was quoted as saying, 

"No self-respecting small businessman with a brain in the right place would ever employ a lady of child-bearing age” – and he has also bee attributed with such classics as: “I don’t think women clean behind the fridge enough" and  "I am here to represent Yorkshire women who always have dinner on the table when you get home.”

Bloom was accused of sexual assault, making "sexist and misogynistic remarks" and using offensive language during a dinner party in Brussels.

And he also confessed that he had visited brothels in Hong Kong adding that he never touched the goods, and also claimed "terrified young women beaten into prostitution often from Eastern Europe  is only a very small aspect of the flesh trade", and concluded that "in short, most girls do it because they want to.”

On second thoughts – if he has taken a leaf out of Bloom’s book he’ll settle well in Pattaya. But if he’s being asked to cough up one third of £2.24 million – he may need to sell more of those policies – so reader beware.

CAN'T BLAME THE VICTIM? BLAME IT ON YOUR BEST FRIEND.


This week there have been more skullduggeries in the case of the Chinese-American millionaire and the young Australian former pupil of the New International School of Bangkok.

This case as we have reported runs in the typical Thai genre of justice - putting the innocent on trial and letting the guilty go on holiday.

We all know the basic story. Jack Hansen-Bartel was in June last year allegedly viciously attacked in the Green Mango Club in Koh Samui, part-owned by a local policeman.  Jack had to go through extensive surgery and even more reconstructive surgery to his face.

Raymond Chang and Ryan Wang were duly arrested thanks to other students who witnessed the incident.  Wang and Chang seemed to put their hands up – but then they came up with the story that they were Knights in Shining armour going to the rescue of a damsel in distress.

This was Tiffany Turner, a half Japanese half New Zealand young woman who had just finished at the International School of the Sacred Heart in Tokyo.  Tiffany was Ryan’s holiday squeeze.

But witnesses and CCTV records told a different story. It shows Jack and Tiffany walking in to the club hand in hand. This was clearly not a person pestering a young lady.  Then we see them being approached by Wang and Chang – and at this point Chang says to Jack something along the lines of ‘Leave off this girl – the chick belongs to Ryan!’

Later on Hansel-Bartel was attacked in a cloud of stage smoke. Doctors say that almost certainly a blunt instrument was used.

It should have been an open and shut case until Raymond Nobu Chang flew into town – after which point the National Council for Peace and Order, which promised transparency – well, er, became invisible, and lawyers recommended by the Australian Embassy appeared to take the commission and then work for the other side.

Annie Hansen had to fire her last lawyer after he came to an agreement with the supposed opposition that Jack should stand stand trial for a common assault but he would have to attend his trial and fly in from Australia (the maximum penalty even if he were guilty would be a small fine) while Chang and Wang, who could have been facing an attempted murder case were told they did not have to bother to attend the court on more serious charges of causing grievous bodily harm.

This lawyer came recommended * by the Australian Embassy and also by the British Embassy in the case of teacher Adam Pickles who was attacked in Pattaya. In the Pickles case he was fired too.

Rightly suspicious that something was amiss Annie Hansen spoke to the United States FBI wondering whether something could be done under the US Corrupt Practices Act, which applies to bribing of officials overseas.

Unfortunately this has to be done, according to the FBI, through the Mutual Legal Assistance Treaty. This has to be done through the Royal Thai Police who said they would – but haven’t.

Makes you wonder who thought up these Corrupt Practices Acts, Britain and Australia have them too – if they require police in Thailand to actually act on them!

Last week however Jack Hansen-Bartel’s new lawyer, who at the moment seems better than most on any Embassy list, went down to Koh Samui court to find that a representative of the fired lawyer was in attendance and talking with the opposition trying to arrange the latest deal.

Further there appeared to be lots of contact between her lawyers and those of Raymond Chang they she did not know about. Of course opposing lawyers need to talk to each other but on this day this person  was not even on the case and was still being invited to participate!

There is no doubt that lawyer had been fired. I have seen the correspondence.

What was happening? The Changs had requested that both trials should be held simultaneously and the charges against Raymond Chang should be reduced to a misdemeanor while Ryan Wang copped the lot. (So much for school buddies. I doubt Ryan knows about this). The prosecutor was in on it.

The father of Tiffany Turner has already stated that his daughter would not be giving evidence in the trial.

The new lawyer got there in the nick of time…….Now they will I understand try to introduced the attempted murder charge or re-instate charges relevant to the viciousness of the attack.

This case in Koh Samui can really be held up as an example of how justice in Thailand works at its worse and how in reality the country does live in the ‘Dark Ages’

Meanwhile Raymond Nobu Chang, the millionaire father, who made a fortune out of Microsoft and who attended the John F Kennedy School of Government at Harvard, and who has helped smooth the path for his son through a retired police general is rumoured to be running for office in the US.

In this video ‘Brian Goldie makes his television debut. An investigation team put the thread of Goldie’s life of extortion together from Scotland to Australia to Thailand where he is known as Brian Goudie.

This 47-year old Scot born in Falkirk has variously posed as a mining engineer, barrister and former officer in the Royal Marines and befriends people and listens to their problems before using the information they give him against them.

I have seen the full version of this film of course because I assisted the film crew but I do not think it went to air in the UK – because it was based on swindlers in Asia.

Brian Goudie is appealing a three year jail sentence in Thailand for cheating a 78-year-old mother Barbara Fanelli Miller out of nearly US$300,000.  He also faces charges of ‘revenge porn’ and fraud.

Together with another lawyer  American Drew Walter Noyes, he has made a career out of swindling foreigners in Thailand. Drew Noyes was sentenced along with Wanrapa Boonsu to 3 years in jail for extortion.


He recently boasted to this site: “I have so much cash I can stay on bail until the cows come home.”
Meanwhile he continues to try and destroy his enemies with his Google sites CasewatchAsia and AndrewDrummondWatch.

BUT 'SEE YOU SOON' WRITES SCAMMER TO THAI COP AS HE FACES JAIL OR ARREST WARRANT


Now skulking in Wilmington, North Carolina, Drew Walter Noyes, the infamous former publisher of the now defunct Pattaya Times newspaper has today through his lawyers  withdrawn a second case he brought against Kanokrat Nimsamoot Booth – as a result of not being able to return to Thailand.

This apparently despite telling a Pattaya police officer on Facebook ‘ See you soon’.

Noyes was accused of appropriating the Facebook page of Ms Warichaya Pharawet, known as Naam, to make libelous comments about Ms Nimsamoot, who had been assisting the author of this site

But, as is customary, both had to be jointly charged with libel.

Naam who had never met Ms Nimsamoot, could barely write English and knew nothing of the content she was accused of writing.

But Naam was found guilty and Noyes innocent such is the Pattaya court system.

Noyes today dropped his counter-charge and once again lawyers explained that he was away in the United States and unable to return to continue the case – let alone face the enactment or otherwise of a two year sentence for extortion, which he is supposed to do on Wednesday.

Having been used by Noyes Naam was ditched and is reported to have found a foreign boyfriend and is now no longer living in Pattaya.  She was given a one year suspended prison sentence thanks to her mentor and lover.

Noyes readers may recall got himself elected to be President of Lion Club 310D Silom, and Naam was the secretary!



The second charge Drew Noyes withdrew followed his acquittal in a case brought by Andrew Drummond, Kanakrot, and Ally Cooper against Drew Noyes, Goudie and David Hanks, Noyes had been acquitted of libels in the Pattaya Times claiming he was not the owner..and the court accepted it (He had transferred ownership to an businessman in the U.S. (Let's not go there).

Two further cases Noyes brought against the alleged publisher of the internet forum subzerosiam and Ally Cooper, an oil platform superintendent, have not been dropped but are expected to be thrown out, over the next month.

Subzerosiam was the initial publisher of the photo-shopped ‘gay parade’ pictures of Noyes and Brian Goudie, who has been sentenced to three years in prison for posing as a lawyer and former officer in the Royal Marines.

Cooper was merely accused of sharing a Facebook page from Andrew-Drummond.

The summons against him was sent to a hotel in Isaan at which he had never stayed.  But who is to explain the workings of the Pattaya court.

Goudie has been asked to appear as a witness for Noyes in the Subzerosiam case on November 27th.

 At this point it is expected he will be confronted by his fan club with the television documentary ‘Brian Goldie – Serial Swindler’  together with Thai translation.

Goudie himself has to surrender to bail on December 14th to pay bail on a series of charges,

The most interesting of which relates to ‘revenge porn’ brought by Boonrod Baikratok former managing director of Jimmi International, which Goudie got from Ulster drugs trafficker Jimmy ‘Doc’ Halliday on his death  bed.

Halliday died of necrotizing fasciitis a flesh eating disease acquired in Nong Plalai Prison where he was serving a sentence for an attack in a Lucifer’s disco Pattaya.

Meanwhile Wanrapa Boonsu, Noyes' common-law-wife and mother to three of his ten children - is continuing to operate Noyes' extremely dodgy 'One Stop Service Center' also known on the web as 'PattayaLawyers' or 'OneStopLegalCentre' advising foreigners on what to do with their money and property.

She believes she will be acquitted on Wednesday being the lessor Thai accomplice.

But if truth be told it is unlikely Noyes could have carried out half his scams without her.







Apparently a new series of 'unhappy' clients are now seeking alternative legal advice in Pattaya but other lawyers are loathe to touch the cases because of the Noyes connection.

Meanwhile it would be interested to see if the Star in Wilmington, North Carolina catches up on its old friend Drew.

THAI MILITARY MOVES AGAINST ACADEMICS IN CLAMPDOWN ON KNOWLEDGE

Thailand's military led government has issued a summons against a group of university professors claiming their meeting to discuss freedom of knowledge in education was against the law.

The group in Thailand's northern capital were, according to the government, in breach of an NCPO order banning political gatherings of more then five.

The Government may as well save time by outlawing lessons, lectures, seminars, conferences,... then there's stag nights, hen parties, and military parades.

 Thai Lawyers for Human Rights, who of course are banned from meeting in groups of five or more have of course rightly objected.  Otherwise Thailand seems a bit mute on the subject.

This is their statement.

On 11 November 2015, Changpuak police station, Chiang Mai, issued summons for a group of six academics from various universities. 
The summons order accused the group of holding or participating in a political gathering of more than five people which defied the announcement or order of the Head of the National Council for Peace and Order (NCPO), after the group held a conference to express their academic opinions on freedom of knowledge in education system at Chiang Mai on 31 October 2015 
Human Rights Lawyer Association (HRLA) and Human rights organizations have the opinion that the expression of academic opinion is a legitimate practice under human right principle and law as follows; 
1.       The academics’ opinion conference on freedom of knowledge in education system was to express academic opinions about higher education, which is a public topic and a direct objective of university academics. 
This academic freedom is prescribed and guaranteed in many previous constitutions of Thailand, such as Article 42 of the 1974 Constitution, Article 42 of the 1997 
Constitution, Article 50 of the 2007 Constitution, or even in the interim constitution that was enforced after the 2014 Coup d’état, this freedom is inplicitly guaranteed in Article 4 and 5. Therefore, the academics were using academic freedom that is prescribed and guaranteed by the Constitution. 
2.       The accusation that appeared on the summon order cites the violation Article 12 of the NCPO’s order No. 3/2015: “Political gatherings of five or more persons shall be punished with imprisonment not exceeding six months or a fine not exceeding ten thousand Baht, or both, unless permission has been granted by the Head of the NCPO or an authorized representative.”, which the NCPO’s announcement No. 3/2014 issued to be under the jurisdiction of military court, cannot apply to this academics’ opinion conference as it did not meet the element of the offence. 
The conference was not a political gathering but a normal academic activity that is a custom and important task for Thai academics. 
If such activity is interpreted arbitrarily to be an illegal assembly or political gathering, it will result in many academic activities set to expand knowledge and solve social problems, such as academic seminars, academic conference, academic lectures,  research presentations, community workshops that are organized all over the country, to become illegal and impracticable. 
This will lead to the imponderable damage to Thai society, both in the present time and future. No rightful law would intend to have this terrible consequence. Moreover, the acknowledgement and protection of academic freedom in the Constitutions in the past and present confirm that the academics’ action in expressing opinions was bona fide under the constitutional rights and liberties, and not an offence of political gathering as in the NCPO’s order. 
By the reasons listed above, Human Rights Lawyer Association (HRLA) and the undersigned human rights organizations have the following proposals: 
1.      We encourage the accused academic group, as well as all academics, to have the courage to stand for academic freedom and carry on their valuable duty as public intellectuals with bravery. 
2.      The NCPO, the government, the army, and the police must stop using law to threaten academics, by cancel the charge against the academics who did their job rightfully under constitutional academic freedom. 
3.      Together, Thai people must demand the NCPO, the government, the army, and the police to respect academic freedom and stop the intimidation and threatening to the academics who work honestly as the society’s intellect.

Footnote:The author was amused at the plan by the Indian Medical Association to hold its conference in Pattaya.  The conference has now of course been cancelled and the doctors grounded (to India). But to be fair to the medicos, neuro surgeouns, spine specialists etc., Pattaya must be a medical and psychiatric heaven for research fellows even if only a couple of foreigners fell from high places during their stay.
Of course they may have been more tempted to research the go-go bars. 

Perhaps the academics should have held their meeting at The Spotlight a go go in Chiang Mai.




KILLER PAID OFF THAI COURT TO ENJOY THE FJORDS AGAIN

A SWEDISH VIEW OF THAI JUSTICE

A journalist on a Sweden's biggest newspaper Aftonbladet has just described one of the ugliest days in court he has ever seen. He was actually talking about an up country court in Sweden but the case was one of murder and it happened in Pattaya.

Problem was of course that the evidence was provided by the Thai police.

On trial was Andreas Ringvall, a Swedish sailor with a previous record charged with the murder of New Zealander Robert Hollick in Pattaya in 2012. He alleged stabbed Hollick to death in a frenzied attack after a row began when Hollick entered the bar Ringvall was drinking in with a boisterous dog. It was premeditated because after the initial argument Ringvall returned with a knife.

The case seemed cut and dried. There were witnesses, and a murder weapon and an arrest was made very quickly.

But then Ringvall entered the court system. He was given bail at the rate of Bt500,000 and then for a sum not disclosed as given permission to return to Sweden for a family visit.

Not surprisingly he did not return. Eventually the Office of the Attorney General in Thailand was forced to make a groveling apology for his release – not something the Pattaya seemed too concerned about. The sugar cane had after all entered the elephant’s mouth.

Intranee Sumawong, Director of international affairs at the office of the Thai attorney-general, said:

 “I really would like to send a message to [Hollick’s] family that we are very sorry about the situation. 
 We feel responsible and, as the public prosecutor of Thailand, I will do my best to make sure justice is done in this case.”

Thailand does not have an extradition treaty with Sweden. So Swedish prosecutors, aware of the publicity surrounding the case and pressured by the Thais, eventually decided to prosecute themselves.

Hollick’s mother Anne who exclaimed that she hated her son living in Pattaya was quoted as saying

“I’m pleased, relieved a bit, because the thought of him living as an ordinary Swedish citizen, just living his life like nothing happened .”

The Dominion newspaper had run a campaign chasing the Thai authorities to do something.

Anne Hollick spoke to soon. As the Swedish case was based on the Pattaya Police investigation it fell far below international standards.

The post mortem was ‘amateurish’. This may be because it was written by a policeman not a doctor. The scenes of crime evidence were not existent. The murder weapon had been lost. Thai witnesses summonsed by the prosecution demanded large sums of money so their testimony was barely credible and the Thai interpreters were dodgy too apparently.

Ringvall just got eighteen months for aggravated assault and manslaughter.

Writing in Aftenbladet last week columnist Oisin Cantwell said:“I left the beautiful court building, looking out over Riddarfjärden and found myself thinking that I never want to see something like this played out in a Swedish courtroom again.”

The prosecutor admitted there were shortfalls in the Thai investigation.

Swedish blogger Jan Kallman said he totally agreed with Oisin but it was the corrupt Thai justice system which was to  blame.

“It has to be understood that criminals who come to Thailand and hide come with the knowledge that it is possible to bribe their way in the legal system.  
“ All people who are innocent and honest should avoid the police. If you see Khun Kling & Klang on the way to a traffic accident or crime scene where you yourself are, just run AS fast as hell from there. Never stand up as a witness - it can end with you being charged with the crime.”

And the moral is: If Drew Noyes turns up in court today to hear his appeal against a jail sentence for extortion, then he the result has been decided and he will shortly be conducting legal seminars with the local judges again.

Arrest warrants for extortion were issued at Pattaya Court today for the American Drew Walter Noyes and Wanrapa Boonsu who cheated foreigners while running the Pattaya Times and One Stop Legal Service Center in Pattaya.

The couple, who dined with judges in Pattaya,  had already been sentenced to two years in jail each, but were allowed bail to appeal the judgment.

Noyes fled back to the United States to Wilmington North Carolina where in 1995 he was originally exposed by the Morning Star newspaper under the headline 'Trouble Follows Developer'.

DREW NOYES DID NOT CARE WHERE HIS MONEY CAME FROM BUT NEITHER DID THAI OFFICIALS.

Serial confidence trickster Drew Walter Noyes and his Thai woman partner Wanrapa Boonsu officially became fugitives from justice today as Pattaya Provincial Court finally issued a warrant for their arrest after they fled on bail.

The couple who published the Pattaya Times to prey on tourists and expatriate foreigners, failed to turn up to hear the result of an appeal against their two year prison sentence for extortion.They faced immediate incarceration if they lost again.

Both had paid out sizeable amounts of cash for bail and the Pattaya Court had taken even more cash to allow Noyes to travel back to the United States with some of his children.

Noyes’s career as a con-man in Thailand was first interrupted when we exposed the fact that he was not a lawyer as he claimed.

(But it dates back to the 2004 Tsunami when he was accused of pocketing cash raised for victims of the disaster.)

 He had been taking cash off American pornographers in Pattaya to pay off Thai police and thus allow the filmmakers to continue exploiting Thai country girls at knock down rates performing in porn films unprotected in any way – let alone by US laws governing the trade.

Most of those films remain on the internet to this day.

Through their businesses PAPPA Co. Ltd and One Stop Legal Service Center the couple lured foreigners into handing over their cash on legal bills for work in relation to mixed marriages, property deals, and even visas.

He even advertised for Filipina staff on social media, employed them illegally, and was accused of sexually assaulting them then firing them when resisted and complained they were not given the promised cash.

Noyes cultivated judges at the Pattaya Court and whenever a foreigners complained he would threaten them under Thailand libel laws.  After he was exposed on this site he was however forced to make out of court settlements.

When he went to court he surrounded himself with bodyguards American Jerry Weinerth and Scot David Hanks, who ran a brothel in Melbourne, Australia.

He would scream the house down with indignation at the accusations against him and delayed cases against him by pleading jet lag, a problem in the nether regions, or blaming it on his children, one of whom he even used in a video to promote his crooked businees.



He even set up a legal seminar with the judges and conned the biggest foreign web forum in Thailand – ThaiVisa.com – to broadcast it and he declared he was the international adviser to Ittiphol Khunplume, the Mayor of Pattaya, a statement which the Mayor never denied.

And with the police he organized a conference with the Crime Suppression Division in Pattaya and even created a CSD website to encourage foreigners to report on foreign ‘criminals’.

Noyes frauds were so brazen that he even sold Housing Authority property built for poor Thais to foreigners at extortionate prices and he talked himself into being variously the unelected President of the Pattaya City Expats Club, the Pattaya Optimists and up until last year the Lions Club 310 D of Silcom, Bangkok, which he joined with a bar girl as his ‘secretary’.

Noyes was the consummate sex tourist. He fathered some nine children in Thailand, four by a wife, three by Wanrapa, one by a member of staff at PAPPA and the nineth by his wife’s 14-year-old niece and he trawled the bars with fellow American Brian Wright looking for young talent.

Wright has since been sentenced to jail for child sexual abuse.  He boasted on video about the ability to have as many mistresses as he could afford. And he spoke about the Clinton-Monica Lewinsky incident saying that in Pattaya society Clinton’s wife would have found it totally acceptable.

In the United States he was exposed by Scott Gold in the Wilmington Morning Star in a major feature in April 1995 when he was accused of property and share fraud and demanding oral services from a female member of staff – on pain of cutting her work hours.

The law, such as it is, finally caught up with Drew Noyes and Wanrapa in March 2012, when they were arrested by police for attempting to extort the Thonglor Clinic Pattaya out of seven million saying if he did not cough up he would be raided by the CSD and illegal substances would be found and the publicity in the Pattaya Times would destroy him.


As for Wanrapa Boonsu. She was a willing and able assistant who helped organized and profit from his scams.

Drew Noyes is gone. Apart from his lawyer the only person to witness the order for Noyes’ arrest was David Hanks the former pimp.

 Hanks himself had been acquitted or racketeering in the resort – money lending to Russians at 60 per cent per month – as the court had taken money from his co-accused Russian and allowed him to go home to Russia and the DSI had lost their witnesses.  In Thailand unfortunately it’s just a matter of price.

Now its up to the good folks of Wilmington, North Carolina. Scott Gold of The Star was the first person to report this man was living a 'myriad of lies' - Its going to be interesting to see what Noyes tells the folks back home.


THAI POLICE BRIBERY - THE 'JESPER' BACK STORY

JUST HOW SHOCKED WERE THE PATTAYA POLICE?

Readers of the Bangkok Post and even Khao Sod might have been given the impression that
police down in Pattaya were shocked at the activities of Jesper Kongerskov or Hansen or Leon Christiansen as he calls himself now.

Danish Jesper, a former Pattaya Volunteer policeman, was charged in connection with shaking down a fellow countryman for 800,000 Thai baht in 2012. His victim had been arrested for child sexual abuse.


This of course begs the question – Why did they not arrest him before if police were so upset? 

He was hiding under his new name seems to be the answer they are giving.

We have exposed him on this site much more recently. Acting as a foreign volunteer policeman he tried to stiff a totally innocent American  - Chris – out of a large amount of money to get him off a child sex abuse charge – and was essentially told go get lost. The American man is now taking multiple law suits alleging conspiracy.

And Briton Thor Halland, who was set up on charges by Drew Walter Noyes with Pattaya police help, said he was ripped off by him for some 200,000 baht. We reported it here.

But more recently he ripped off a third person Briton Ian Tracey -   who has since been acquitted of child sexual abuse (also reported here) through another Pattaya policeman.  This time he wanted to charge Tracey for stealing a car.

In fact the car belonged to Thor Halland who left it with Tracey to sell as Halland decided not to hang around on a trumped up charge.

From the UK Halland wrote an affidavit and power of attorney to Tracey – who by his T shirt takes a dim view of the Pattaya police and is not scared to show it and Tracey was released.

Jesper the extortionist had carrying on his extortions to the present day dealing with Pattaya officers all the time.

No the story here is not that a Pattaya policeman was shocked that he was shaken down for a bribe. The problem was that police like to control the bribes not some Dane with delusions of power in a Thai police uniform.  And like fake lawyer Brian Goudie, Jesper got too greedy.

And over the years the go-betweens negotiating the pay-offs have not only been lawyers but a range of foreign volunteers and even a Pattaya newspaper man, who also charged for keeping the story out of the paper.

Its business – after all even the courts in Pattaya allow the resident bail bondsmen to charge clients 50 per cent for their loans!


The arrest of the American, which has also been well documented on this site, was probably the catalyst.  He created a song and dance which is not surprising.  After the allegations were made be became a world pariah.

He had an excellent job with a multi-national which had to let him go and overnight became unemployable.

This week ‘Chris’ was called by police down to Pattaya to identify Jesper and was with Immigration police on two successive days.  Jesper is now in custody and it looks like the book will be thrown at him.  He has already been presented with charges of trying to extort the Dane and the American. But he played with fire.

But take Thai newspaper reports on this with a couple of rocks of salt.

UNBEATABLE BLACK FRIDAY OFFERS FOR FOREIGNERS.

CUT PRICE EXTORTION?

Sometimes you really have to laugh. 

Just a day after warrents of arrest were ordered for fake American lawyer Drew Noyes and his Thai sidekick Wanrapa Boonsu, who were sentenced to jail for extortion, up crops Wanrapa again advertising their  One-Stop Legal Services in Pattaya, Thailand at discounted rates.

Here she is with the her staff, which seems to be cut down a bit since the glory days advertising discount legal advice on Black Friday?

Black Friday? Well as far as I know there’s no Black Friday in Pattaya.  It’s the day after American Thanksgiving and regarded in the US as the start of the Christmas shopping season, Britain is trying to copy it. So shop early at and get reduced extortion at One Stop Legal Services Center.

 That’s not the real company name by the way but who cares.  If you think you’ve been cheated and tell them so you’ll be threatened with prosecution under Thailands criminal libel or if you comment on net, computer crime act libel laws.

November 25th was ‘Black Wednesday'’ for Drew Noyes and Wanrapa Boonsu when Pattaya Provincial Court ordered their arrests for failing to turn up for their appeal against conviction and sentence to two years imprisonment for the attempted extortion of the  owners of the Thonglor Clinic.

Their message to joint owner Michel Goulet was that if you want to work in our town you need to pay us 7 million baht. And if you don’t you’ll get raided by police where illegal products will be found and that won’t look good in our newspaper the‘Pattaya Times.' *

So is Wanrapa on the run or not? Clearly not as she is proud to show.  She apologized to the court and said she was too ill to attend.  Never mind said the judge. Come back in a couple of months’ time.
Noyes of course has fled to the United States.

If you are a foreigner in Thailand and need a lawyer. Don't use one employed by this company.  After all Drew Noyes and Wanrapa did not. Most of the time they use a lawyer for Bangkok. But they do not recommend that to their clients.

Oh and in terms of wills watch that percentage clause!  And in property deals their advice is simple. Don't put your property in your Thai wife's name.. that could be disastrous, Put it in the name of my wife Wanrapa.' Drew Noyes put property in his wives names, If you are going for a divorce - make sure they get your Thai wife\s name right. It won't be the first time they got it wrong.

This company is not on any Embassy's list for foreigners in trouble.

AUSSIE MUM PROTESTS CORRUPTION AT THAI PARLIAMENT

An Aussie mother stages a sit in at the Thai Parliament to complain about rampant corruption in Thailand. The victim is her son Jack Hansen-Bartel a former studentsof the New International School  in Thailand (NIST) who was savagely beaten in a police controlled party bar in Koh Samui.



The two accused are Chinese Americans Raymond Chang and Ryan Wang both former pupils of the Shanghai American School. As a result of the attack, in which a heavy object is thought to have been used, Jack had to have millions of baht in surgery and corrective surgery to his face.

The prosecution of the two young Americans seemed to be going ahead – and then after the father of Raymond Nobu Chang, the millionaire father of Chang(jnr) flew in the world reversed on Jack – a scholarship pupil, who had been looked after by his divorced mum for 15 years in Thailand.

Police on Koh Samui now wanted to charge Jack with common assault (for which the fine is under US$100). They even flew a policeman to Bangkok to interview and charge him.  Cost a minimum of US$300 – and the Samui police do not have the cash and would never waste it on a normal case.

Even the National Council for Peace and Order expressed concerned and they witnessed the occasion – but did nothing.

Neither did the police, prosecutor, Interpol, the Australian Embassy, the Thai National Human Rights Commission (stripped of its powers) or if they did it was not enough.

So Annie Hansen went it alone relying heavily on donations. It is a tribute to her tenacity that the case got this far. Her adversary Raymond Nobu Chang made much of his cash out of Microsoft, attended the John F Kennedy School at Harvard, and has pulled out all plugs.

Unknown to her even her lawyer (the last of many) agreed that Raymong Chang and Ryan Wang did not need to turn up for their trial for serious offences – while Jack has to fly from Monash University in Melbourne, where he is studying, to attend his trial for a misdemeanor, which of course he is contesting.

The defendants claim they went to the assistance of a damsel in distress - Tiffany Turner - a former student at he International School of the Sacred Heart in Tokyo.  Hansen-Bartel was harassing her, they claimed.  CCTV coverage of five hours at the club shows at the night in question in June 2014 the opposite.

In desperation it seems Raymond Chang’s father has now got the courts to turn the spotlight away from his son and is now blaming Ryan Wang for the attack.

There goes a school friendship.




Annie’s sit in in Parliament attracted a lot of attention in the Thai language press – but none in the English language newspapers in Bangkok who like to protect the country’s image abroad.

It’s another step forward in her battle. She has won the moral and ethical war.  Unfortunately in the Thai justice system morals and ethics are low on the pecking order.

The case of Jack Hansen-Bartel was first raised on Andrew-Drummond.Com and has been widely followed by the Australian media.

Among numerous other cases the site also first highlighted the case of the Vard  family – robbed of seven houses by a crime syndicate involving lawyers, a bank, money lenders and police. That case was also taken up by the media in Ireland and Thailand and continues to be monitored.

And then there is the case of Vanida Boongeon whose Pakistani husband was murdered in Chaiyaphum and police hid the file and did not even send the results of the DNA tests of the killer’s blood to the public prosecutor. (update soon).

And the case of Chris X who was blatantly falsely accused of child sexual abuse in Pattaya – by a system that financially profited from arrests. He now is suing in the US.

Our campaign also brought Police Sergeant Uthai Dechachiwat to account for the murder of Leo del Pinto in Pai, Northern Thailand.

And we have seen fake lawyers Scot Brian Goudie and  American Drew Noyes jailed for three years for defrauding a 78-year-old woman and 2 years for extortion.  And we have sent Noyes on the run because the Thai system allowed him bail after his conviction.

We have been blocked in Thailand by the government which does not use the courts and we are always under attack – currently from boiler room operators – so your support is always needed even it its only moral.

THAI MILITARY SENSITIVE ABOUT CORRUPTION ALLEGATIONS

Thailand’s military government, which is plagued with its own corruption problems having taken power on ant-corruption pledges, is now being accused of detaining the mother of a student leader to stop him demonstrating.

Sirawath Seritiwat said he will demonstrate ta Rajabhakti Park tomorrow- the park is a military project to pay homage to the King of Thailand and has allegedly been built in Hua Hin, 100 miles south of Bangkok out of funds raised from the love of Thai people…except it isn’t.  The Thai tax payer had to pay too and a lot of people were apparently shaken down for cash.

There have been numerous allegations of bribes and corruption involving all aspects of the park’s creation and the casting of statues of the King and Kings gone by costing up to a US$1 million a piece.

It’s a sensitive subject.  The park is said to have been named by the King and its name apparently translates as "the park built with the people's loyalty to the institution of the monarchy".

The Thai sovereign King Bumiphol Adulyadej who has his summer palace 'Far from Worries' in Hua Hin was not in a fit state to open the park personally.

Regarding the persecution against Mr. Sirawith Seritiwat and his family

As Mr. Sirawith Seritiwat, a student leader, has announced the plan to make an excursion to the Rajabhakti Park plagued with scandalous corruptions and to organize some activities there on 7 December 2015, since 5 December, the Thai military officers have tried to approach him asking him to cancel the event and invite him for a meeting. 
The student leader has declined the invitation to meet and simply turned his communication devices off. Being unable to reach out to him, the military officers have gone to meet his mother at her home instead asking her to convince her son to call off the event. They even threatened her that by not following their order, the family could not blame them for any ‘consequences’. Of late on 6 December, his mother was contacted by the military officers again and was asked to meet with them in a military barrack this afternoon.
The Thai Lawyers for Human Rights (TLHR) has found the behavior of the military officers a gross infringement on rights and liberties of people and unlawful. The Order of the Head of the National Council for Peace and Order (NCPO) no. 3/2558 simply authorizes the Peace and Order Maintenance officers to summon a person to report themselves or to give information on matters particularly concerning any culpabilities related to the offence against the monarchy, national security, and the law concerning firearms, ammunition, explosives, fireworks, and the equivalent of firearms, or any offence related to the violation of either the order or announcement of the NCPO or the order of the Head of the NCPO, only. 

Therefore, the deprivation of liberty against the mother of Mr. Sirawith Seritiwat in order to stop him from embarking on his trip to the Rajabhakti Park has nothing to do with any of the four offences. Such an act is simply unlawful given that there is no legal basis for it to be carried out. 

In addition, the act can be construed as an offence as per Section 157 of the Penal Code concerning the abuse of office, Sections 309 and 310 regarding a breach of liberty and an act of arbitrary detention which is a breach to Article 9 of the International Covenant on Civil and Political Rights (ICCPR). Any person subject to such detention can seek a judicial review asking the Court to have them released from any unlawful detention by invoking Section 90 of the Criminal Procedure Code. 

The Thai Lawyers for Human Rights (TLHR) urges the military authorities to immediately stop such persecution against civilians by invoking the Order of the Head of the NCPO no. 3/2558 which has been issued by the virtue of the draconian Section 44 of the 2014 Interim Constitution.

Flying Sporran's Diary

The Sea Shepherd organiosation  is  reportedly re-embarking on another crusade against the fishing trawler Taishan which earlier this year had Thai officials blinking as its crew reloaded its catch (so its reported) and slipped its moorings while its Captain and crew were allegedly ‘under arrest’.

This trawler and others are technically pirate ships as they keep changing their names and use fake countries of registration to carry out an illegal trade in Patagonian Tooth fish also known as Chilean Bass.

The ships had been pursued by the navies of New Zealand and Australia and the Australian navy stopped the Taishan off the Cocos and Keeling Islands which just happens to be one of the more delightful spots to which I have been sent as a foreign correspondent.

 (Every Friday the Aussies based there go to a point and stand under a treet on the main airport island for the Sundowner to swill tinnies under a tree.

Anyway as has already been revealed there has been an Interpol Purple Notice out against the Taishan (under the name Kunlun)  and its sister ship 'Thunder' so there was some delight from the world authorities when the shipped docked in Phuket.

I don’t know why.  Behind its glitzy beach hotels and white sand beaches Phuket is the Asian equivalent of Tortuga.  The only difference being that the pirate captains tend to wear uniforms with Thai government symbols on them.




British naval captains have chronicled their visits to this island and one Captain simply named it an island of dacoits – a quaint expression rarely used today, except strangely enough by the British educated Burmese.

The reason I am touching on this is because a Phuket poster has just suggested I tackle the subject of Phuket Marine Office 5 chief Phuripat Theerakulpisut who is in charge of everything on those southern islands ‘ below the high tide mark’ according to Phuketwan.

The poster seemed to think that Phuket Marine Office 5 chief Phuripat Theerakulpisut had something to do with the ensuing fiasco.

He is in charge of jet-ski rip offs, or rather the unsuccessful interdiction of such activities and newspapers and websites have been publishing his gibberish for years.  Now he wants to open a ferry pier at Phuket airport to allow air passengers to go by boat to Patong.

This would almost certainly involve talks with the island mafia an/or  Charoen and I would not recommend this trip in the rainy season.

 I once hired a power boat at the rate of US$1,500 per day to go from Phuket marina to the Amanpuri.
Having finished with boat I told the skipper to drop me off at Laguna. ‘No deal it’s more than my job’s life’s worth’ was his reply.’  He would be cutting in on someone else’s patch.

Anyway I doubt the Taishan fiasco had anything to do with Phuripat.  As soon as I saw the Royal Thai Customs were involved and handing out press pictures of their seizure I guessed this one was going west.

Charoen Chamniklang chief of the Royal Thai Customs Investigation and Suppression Bureau, reported the Phuket Gazette, ‘was able to lay to rest’ some of the concerns by Paul Watson, boss of the Sea Shepherd organization who was suspicious of the Thai police investigation.

“The vessel remains at the Phuket Deep Sea Port, and the fish product is being held at the Songkla Customs office while we continue our investigation,” added Charoen.

This is the point at which old Thailand hands might start chuckling.

Royal Thai Customs announced that the Peruvian captain of the, it’s believed Spanish owned, trawler, was being charged with landing 182 tons of grouper, when it fact it was the much more expensive Patagonian tooth fish.

What seems to have happened is that the captain put his catch – worth just a little short of US$2 million in cold storage while matters were being negotiated with the Thai authorities.

When the deal was done the fact that the ship was about to leave was pretty much broadcast worldwide and the Sea Shepherd organization heard the story by way of Spain.

Anyway the 182 ton catch was reloaded and off sailed the Taishan or in September.

‘We blinked and the ship was gone,” Charoen was reported as saying in the Phuketwan which with Alan and Chutima Sidasathian at the helm had the story first as usual. He's obviously not heard the rumours about 'pieces of eight'.

A lot happens during the blink of a Customs officer’s eye in Thailand. Just as Phuket police have problems missing all those murders of Burmese fishermen whose bodies are regularly found floating near the quay side.  Down Phuket way it seems they do not even wait until they go to sea.

เมื่อวันที่ 18 พฤศจิกายน 2556 หลัง 17.00 น. นาย Jawad Rasheed Khan และเดินทางเข้าไปที่บ่อปลาและไปพบ นาย ทองพูน บุญเงิน กับลูกจ้างคนหนึ่งกำลังขโมยปลาขึ้นรถเพื่อไปขาย ทำให้มีการทะเลาะกันอย่างรุนแรง และนายทองพูน บุญเงิน พูดเหมือนจะทำร้ายร่างกายนาย Jawad Rasheed khan แต่ก้ไม่ได้ทำและทำการขโมยปลา 300 กิโลกรรมสำเร็จ และหลบหนีไปกับแฟนสาว
การชันสูตรศพของนาย Jawad Rasheed khan พบว่ามีลูกกระสุน 3 ลูก มาจากปืน 2 กระบอก และเป็นการจ่อยิงให้ระยะประชิด และมีลอยลากศพอยู่ในที่เกิดเหตุ แต่นาย ทองพูน บุญเงิน ซึ่งนอนอยู่กับผู้ตายให้การว่าเห็นคนร้ายยิงมากจากทางหน้าต่างแต่ไม่เห็นใบหน้าของคนร้าย แต่ไม่มีรอยเลือดติดอยู่บนที่นอน ในขณะที่ผู้ตายนอนอยู่ทางด้านซ้าย นายทองพูน บุญเงิน นอนอยู่ทางด้วยขวาแต่หลังจากถูกยิง ผู้ตายหลังตกลงมากจากที่นอนมาอยู่ทางด้านขวา
ปัญหาหลักๆก็คือตำรวจไม่สั่งตรวจสอบร่างกายผู้ต้องหา แต่กองพิสูจน์หลักฐานตรวจสอบพบว่ามี DNA อยู่ในหลักฐานถึง 3 DNA แต่ก้ไม่ทราบว่าเป็น DNA ของใคร  
คุณ วนิดาบุญเงิน กล่าวว่า ตำรวจบอกว่าจะตรวจสอบหลักฐาน แต่ก็ไม่เห็นทำอะไรเลย

In a remarkable tribute to the failure of Thailand’s ‘fast track’ tourist courts on the Thai holiday island of Koh Samui the trial of two Chinese Americans charged with the vicious attack of Australian Jack Hansen-Bartel in June 2014 has been postponed until the American summer holidays next year.

The same goes for a counter charge of common assault against Hansen-Bartel – normally handled in a police station for an on the spot fine of not much more than US$10.

Remarkably the rich Americans do not have to attend their own trial (which could have been for attempted murder says the defence, due to the head injuries of Hansen-Bartel) while Hansen-Bartel, who has to fly in from Melbourne does.

And the reason for the delay? To hear the evidence of Tiffany Turner a half Japanese half New Zealand former pupil of the International School of the Sacred Heart in Tokyo.

The two American youths Raymong Chang and Ryan Wang are former students of the Shanghai American School are claiming they went to the aid of Miss Turner in the police controlled Green Mango Club in Samui in June 14th.  She was a damsel in distress they claimed in statements and Jack was pestering her.  CCTV acquired by Jack’s friends completely demolishes that argument.

Tiffany Turner meanwhile is studying in the US and jetting back to Tokyo during breaks while feeding Facebook with her selfies. Shy and retiring she is not.  But perhaps most important is that there is no evidence she has been sent a summons. She cannot legally be summonsed and her father a Tokyo based import exporter has announced she will not give evidence anyway.

Tiffany herself has said nothing. But it has been established she was Ryan’s holiday squeeze.
Tiffany has been called to testify not by the two Americans who have pleaded not guilty and not presented any witnesses but by the prosecutions.

Jack of course wanted to put her statement to police under scrutiny.

But that seemed to have lost its point when it was deemed Chang and Wang need not testify or even face cross examination as their as opposed to Jack’s, university education was more important.

Surely the court cannot be solely relying on the statements written and signed by in front of police officers in Koh Samui (there appear to have been more than one as the circumstances ‘changed’.)
Followers of the Thai court system will know how often statements are simply dismissed if they are not backed by testimony – even statements sworn abroad with a government seal.

Following the demonstration by Jack’s mother Annie Hansen in the Thai Parliament building last week and subsequent coverage in the Thai vernacular press, the judges appeared last week to be more sympathetic to Jack’s flight.  But at this rate this may be just a game of ‘pass the parcel’ as the judges will almost certainly be rotated long before a verdict is required.

In his bail application Raymond Chang was portrayed as a good all American boy, a devout Christian and regular church goer.  He could have been standing for office.

His father is Raymond Nobu Chang a millionaire entrepreneur and graduate of the John F Kennedy Law School at Harvard (best known simply as the Harvard-Kennedy School).

He flew into Koh Samui after the incident in 2014 and rescued both boys from the jaws of hell.





However in I guess the tradition of the Shanghai American School Raymond Chang now appears to have ratted on his school mate Ryan, who stands accused of being the instigator of the attack who caused the damage which resulted in Jack having to have multiple surgical operations to his face.
This, says Annie Hansen, flies in the face of the evidence of witnesses who named the richer kid.

Theirs not to reason why?

Here from the Samui Times is part of a report from the party to celebrate the inauguration of tourist courts on the holiday island.

The court hopes to be able to take sworn testimony from tourists the within one working day of any incident that might occur. 
 
If a tourist is involved in a road traffic accident, assault, serious assault, sexual assault or robbery they are advised to report the incident to the local police where the incident took place, it is important to note that tourist will not be able to report a crime with police in Bangkok or back in their home countries. 
Once the report has been made the victim will be escorted for any medical treatment required. The following day they will be escorted to the court where they can give a sworn statement. 
If the suspect has been caught on the same day he or she will have their first hearing. From this point on the victim will be able to travel home and the suspect will be tried in their absence, even if at this stage they have not been apprehended. 
Many crimes in the past have gone unpunished due to victims having to return home or being unwilling to stay after an upsetting crime. The new system will ensure that the perpetrators of crimes against tourist will be tried and convicted if guilty rather than being allowed to commit a similar crime in the future and go unpunished when the victim leaves the country.

LEGAL NOTE:  How the two Americans were allowed to skip their own trial for serious offences while Australian Jack has to attend his trial for common assault is the subject of legal action at the moment connected to an Embassy list lawyer for Jack who acted on his own initiative.


THAILAND UNDER ATTACK AGAIN FOR MISTREATMENT OF MIGRANT HOTEL WORKERS

Fresh after damning reports of Thailand's murderous treatment of foreign labour in the fishing industry, the human trafficking of Rohingya refugees, and ill treatment of Burmese in the pineapple industry a Swedish watch dog groups have now published a scathing attack on how Thai hoteliers treat Burmese workers.



Fair Travel and Fair Action (Shyst resande) have now attacked Thailand's tourism industry and they have asked leading world tourism companies.

In a report, which in many ways mirrors the report by Finn Watch on conditions in the pineapple processing industry featuring Natural Fruit researchers present a picture of an almost contemptible treatment of Burmese workers in hotels in Phuket.



And the reports calls on the TUI, REWE and Ving holiday groups to take action. In Sweden these groups own the country's leading travel companies. Rewe owns Apollo, TUI owns Fritidresor and Ving owns Thomas Cook.

Similarly in the UK Tui owns Thomson Holidays (soon to be phased out) REWE owns Kuoni UK, and Ving of course is part of the Thomas Cook group which includes the Condor Airline. Though British formed and based Thomas Cook is now predominantly German owned.


The report does not name the seven hotels on which the report is based but people reading it might come to the conclusion that the Thai bosses acted in a racist manner and regarded the Burmese as an inferior people.  

That staff for instance were given brick built accommodtion with running water while Burmese had to build their own huts out of waste wood and corrugated iron.

Migrant workers exploited in Thai tourist paradise

Laundry workers who clean the Swedish tourists’ bed sheets in Thailand work 17 hour shifts. The fresh bread at the breakfast buffet is baked by workers who have not had vacation in a year. These are some of the results from Fair Action and Schyst resande’s (Fair Travel network) report "No Holidays for the Burmese."

In the study, it is also clear that the tour operators have not taken action to hinder the illegally low wages of hotel housekeepers and waiters, although the problem has been known since 2012.

This winter, about 300 000 Swedes will go to Thailand for vacation. The tour operators promise luxurious pool areas, pure white beaches and relaxation for the whole family in the "land of smiles". But behind the scenes at the hotels in Thailand, a different reality is found: Wages below the statutory minimum wage, discrimination and no paid leave is everyday life for Burmese migrants.

The seven hotels concerned are used by Apollo (REWE Group), Fritidsresor (TUI Group) and Ving (Thomas Cook Group). Half of the 18 hotel workers that Fair Action and Schyst resande interviewed state that their salary is lower than the minimum wage, making it difficult to support their families. In addition, 15 of them do not get the leave they are entitled to. In contrast to the workers' stories, the tour operators claim that they have checked the salary levels at several hotels in Thailand, and found no deviations from the stipulated minimum wage.

- We highlighted the issue of illegally low wages in Thai hotels already in 2012. However, the tour operators have not taken their responsibility, says Amanda Söderlund, author of the report at Fair Action. She also states that the companies' lack of action is a violation of the UN Guiding Principles.
Fair Action and Schyst resande have also talked to employees of companies that wash linen and supply food to the hotels.


Out of the eleven interviewed Burmese who work for the hotel suppliers, nine earn less than the minimum wage, despite extremely long working hours. In a laundry, employees describe how they work 17-19 hours per day during peak season with only two days off per month and no vacation, although this is illegal according to Thai law.

- I have never been on leave. The boss told us clearly that we were not allowed to take any leave, says a worker who has been employed for more than two years in a meat-processing unit that supplies the hotels with meat.

Based on the findings in the report, Schyst resande and Fair Action recommend the tour operators to ensure that the hotels comply with Thai legislation regarding wages, working hours and leave, and to prevent discrimination of Burmese workers. Apollo, Fritidsresor and Ving should also investigate the working conditions at the hotels' suppliers, and address abuses. In addition, the tour operators should promote freedom of association, so that the employees themselves can demand improvements of working conditions.

COMMENT: Customarily Thailand intially issued blanket denials when reports like this come out. Quite often they over-react, particularly in the case of Natural Fruit, where one of the researchers Briton Andy Hall faces multiple charges of criminal libel and computer crime libel for the alleged damage the report did. Thailand as a rule does not suffer criticism well, whether it is justified or not but the government has been forced to act on human trafficking, conditions in the fishing industry, and more recently its flight safety procedures. The action Thailand takes, like its response, can often be cosmetic only. The country has problems emulating progress in other parts of the world and these have been increased under the current military regime.

'BAD MILITARY AND POLICE CONTROLLED HUMAN TRAFFICKING IN THAILAND'

CREDIBILITY OF THAILAND'S MILITARY GOVERNMENT - DESTROYED AT A SINGLE STROKE

A Thai General has revealed the sham of Thailand’s so called investigation into human trafficking after he fled to Australia to seek political asylum.

Major General Paween Pongsirin the man appointed to conduct an investigation into the trafficking of Rohingyas from Burma after an international outcry has revealed that the investigation was brought to an end before very senior ‘bad’ police and army officers were revealed.

His statement exposes the outright hypocrisy of Thailand’s military leader General Prayuth Chan-Ocha and is likely to have wide international repercussions.

In a week in which Prayuth has ordered investigations into both the American and British Ambassadors in Bangkok for public comments they have made, Paween has made some shocking, but perhaps not so surprising, revelations.

Few people believed that the camps where the Rohingyas were held and blackmailed for cash for their release, beaten, while  women were mass raped, before scores were either killed or allowed to die from deprivation, could actually be set up without the knowledge of the Thai authorities.

General Paween told his story to ABC and Guardian (Australia) in Melbourne. He resigned from the force last month after being told he was being transferred to the south, the heartland of the culprits who wanted to see him dead.

He did not name the major culprits. But says of the 188 arrested he did not believe there would be any serious convictions.

It is not feasible that the military government did not know what was going on.

Not to put too fine a point on it - Major General Paween's comments teeter on the brink of saying Thailand is guilty of genocide. The implications are enormous. It is impossible that the Thai authorities did not know what was going on.  

How will the military government deal with this? The normal procedure for Thailand is to deny. Over the last 20 years they have continously denied scandal after scandal.

But of course Thailand is an hospitably country with smiling friendly people. Just how inhospitable and unfriendly it can be to the less fortunate is something time and time again foreign governments have not taken the opportunity to warn about, some say in an almost reckless manner.

It might now be the time for the world to talk.

Meanwhile those who supported the government and its alleged stand agaist corruption will now know they the military have merely replaced one corrupt regime with another - only this military government claims it is acting in support of that institution the monarchy.
